HomeMy WebLinkAbout691ORDINANCE 691 AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIE'ORNIA, ZONING A PORTION OF SAID COUNTY PURSUANT TO EXISTING ORDINANCE NOS. 475 AND 522 OF SAID COUNTY, AND AMENDING THE SAID ORDINANCES The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance of said County, as amended by Ordinance No. 522, do ordain as follows SECTION 1. The hereinafter described area sit€nate in the County of Butte, State of California9 shall be zoned as an "AmR" (Agricultural Residential) District9 as hereinafter described and subject to all of the restricted uses applicable to an "A-R" District, said area so zoned being located in the community of Paradise, California, particularly described as followso Beginning at the center of Section 139 To 229 No Ra 3E9 thence easterly along NorthmSouth halfmsection line to its intersection with East boundary line of Paradise Irrigation District; thence northerly along said East Boundary of Paradise Irrigation District to its intersection with the easterly extension center line of Wagstaff Road and center line of Wagstaff Road to its inter- section with the East-West half-section line of Section 129 T. 229 N.R. 3E; thence southerly along said half_section line to the point of beginning,, SECTION 2. The following regulations shall apply in an 11A-R" District: 2.1 Uses permitted: 1) One-family dwellings, not including tents or trailersa 2) Accessory buildings pertinent to permitted useso 3) Agricultural uses9 esecept livestock and poulta~r farming. 2,2 The following uses subject to the seeming of a Use Permit in each case: 1) Two-family dwellings and multiple-family dwellings. 2) Golf courses and country clubso 3) Public and quasi public uses including chinches, fire houses, hospitals, parks and playgrounds9 schools and public utility buildings. 4) Private stables. 5) Poultry farming and livestock farming. • 6)--.-.Veterinary. cla.nics. 2.3• Minimum building site area requiredo Eight~thousand9 one hundred and twenty-five _($,125) aquare feet. 2q4 'Minin4um building site width requiredo Sixty-five (65) feet, 2.5 Minimum front yard requiredo Twenty-five {25) feet, 2.6 Minimum side yard required: Six (6) feet. ~.SECT2013 3,. In addition to the uses_permitted and authorized under Section 2, and solely within that portion of the district hereinafter specified, "C-1" or Light Commercial uses may be permitted subject to the scouring of a Use Permit in each case: ao Land within a radius of five hundred (500) feet from the intersection of Pentz Road and Wagstaff Road and having frontage on Pentz Road9 the depth shall not exceed three hundred and fifty (350) feet on'each side of the center line of said Pentz Road. ~1T G 9/ b. ' SECTION 1~. All uses of Land within the District not specifically authorized an3 permitted under Sections 2 and 3 are prohibited. SECTION 5. Penalties for any violatien of the zoning hereby imposed within the District shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and a part of the Zoning Enabling Ordinance. SECTION 6, This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (15) days after its passage this Ordinance shall be pub- lished once with the names of the members voting for and against it, in the Paradise press , a newspaper published in the County of Butte, State of California.
