BOARD OF SUPERVISORS
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION APPROVING AGREEMENT AND AUTHORIZING
CHAIRMAN TO SIGN
WHEREAS, this board wishes to enter into an agreement with
the County of Plumas with regards to community mental health
services; and
WHEREAS, said agreement has been prepared and is attached
hereto as Exhibit "A",
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors
of the County of Butte, State of California, that this board
approves said agreement attached hereto as Exhibit "A", and the
chairman of this board is hereby authorized to execute said
agreement on behalf of the County of Butte.

County of Butte, State of California, this 8th day of July, 1969,
by the following vote:

AGREEMENT FOR FURNISHING COMMUNITY MENTAL
HEALTH SERVICES
THIS AGREEMENT made and entered into this day of
1969, by and between COUNTY OF BUTTE, a
political subdivision of the State of California, as first party,
and COUNTY OF FLUMAS, a political subdivision of the State of
California, as second"party:
W I T N E S SETH
WHEREAS, Section 5609 of the Welfare and Institutions Code
of the State of California authorizes counties to contract for
the furnishing of Community Mental Health Services subject to
the approval of the Director of Mental Hygiene of the State of
California; and '
WHEREAS, pursuant'to the Short Doyle Act, the Board of
Supervisors of the County of Butte has, by Resolution No. 66-88,
passed and adopted on June 14, 1966, established a Community
Mental Health Service; and
WHEREAS, it is the desire of the County of Butte and the
'County of Plumas to enter into an agreement pursuant to Section
5609 of the Welfare and Institutions Code of the State of Calif-
ornia, whereby the County of Butte will furnish to the County of
Plumas, Community Mental Health Services as hereinafter provided,
NOW, THEREFORE, it is mutually covenanted and agreed that
the County of Butte will furnish to the County of Plumas certain
Community Mental Health Services, all upon the terms and condit-
ions following:
A. OUT-PATIENT SERVICES:
1. At such time as the vacant psychiatrist position is
filled in the Butte County Mental Health Services, but
in no event later than October 1, 1969, the County of
Butte will furnish to the County of Plumas a fully
qualified psychiatrist who will provide one day a

month service at an out-patient clinic located in the
County of Plumas. Prior to the appointment of the
psychiatrist and the one day a month service referred
to in the paragraph immediately preceding, the County
of Butte will furnish to the County of Plumas
sufficient psychiatric services to furnish program
continuity, and adequate supervision of the clinical
staff. ,
a. Plumas County shall reimburse Butte County for
the cost of said service at the rate of $20.00 per
hour, including travel time, plus mileage at the
rate of $0.12 per mile.
2. The County of Butte will furnish to the County of
Plumas the services of the Butte County Mental Health
Service psychiatrists for telephone consultations and
conferences. '
a. Such consultations and conferences shall be
furnished as the County of Plumas shall require,
except that they shall not exceed four hours per
week .
b. Plumas County shall reimburse Butte County for
the cost of any such consultations and conferences
at the rate of $20.00 per hour, and Plumas County
will pay telephone charges,
3. The County of Butte will furnish to the County of
Plumas the services o~ the Butte County Mental Health
Service psychiatrist for evaluations at the Butte County
Community Hospital for those patients who may require
diagnostic evaluation not available in Plumas County.
a. Plumas County shall reimburse Butte County for
the cost of such diagnostic evaluations at the rate
of $20.00 per psychiatrist hour.

1 B. IN-PATIENT SERVICES: The County of Butte shall furnish
2 to the County of Plumas in-patient services at the Butte County
3 Community Hospital in Oroville, California, all upon the following
4 conditions:
5 1. Voluntary patients will be admitted to the hospital
g by a psychiatrist of the Butte County Mental Health
q Services or by an active member of the Butte County
g Community Hospital medical staff upon referral for treat-
g ment by any Plumas County physician, by the Plumas County
10 psychiatric social worker, or the Plumas County clinical
11 psychologist.
12 2. Involuntary patients will be admitted to the Butte
13 County Community Hospital only upon the referral by proper
14 Plumas County authorities and upon presentation of an
15 application in writing stating the circumstances under
16 .which the patient's condition was called to the attention
17 of the person making the referral and stating that the
18 person making the referral believes, as a result of his
19 personal observation, that the patient is, as a result of
20 mental disorder, a danger to others, or to himself, or
21 gravely disabled.
22 a. Any such involuntary patient shall be treated
23 under the direction of the Butte County Mental
24 Health Services Staff.
2S 3. Plumas County shall reimburse Butte County for the cos
2g of such in-patient treatment at the then current charge
27 for hospital care other than the services of the Butte
28 County Mental Health Service, plus the cost of services
2g rendered by the Butte County Mental Health Services, whic
30 shall be computed at the rate of $20.00 per hour.

referral before presenting the patient to the Butte County
Community Hospital.
5. All treatment following release from the Butte County
Community Hospital shall be provided within Plumas County
by the attending physician in Plumas County and the Plumas
County locally-based mental helath team, which shall be
comprised of the Plumas County psychiatric social worker
and the Plumas County clinical psychologist.
b. The Plumas County psychiatric social worker shall, upon
the request of the Director of the Butte County Mental
Health Services, make himself available at the Butte County
Community Hospital in order to act as liaison for any
Plumas County resident hospitalized in Butte County.
C. COURT PROCEEDINGS:
1. All judicial proceedings which may, by law, be con-
ducted in the courts of the County of Plumas, including
Court ordered evaluations for mentally disordered persons,
conducted pursuant to Division 5, Part 1 of the Welfare
and Institutions Code, and conservatorship proceedings
for gravely disabled persons, conducted pursuant to
Division 5, Part 1 of the Welfare and Institutions Code,
shall be conducted in the courts of Plumas County. If,
under Division 5, Part 1 of the Welfare and Institutions
Code, intensive treatment is deemed advisable by the
Director of the Butte County Mental Health Services,
he shall so certify to the Plumas County Superior Court.
2. A11 judicial proceedings which are required by law to
be conducted in the courts of the County of Butte, in-
cluding hearings by writ of habeas corpus instituted
by persons detained by certification for intensive treat-
ment pursuant to Division 5, Part i of the Welfare and
Institutions Code, and including post certification

procedures for imminently dangerous persons conducted
pursuant to Division 5, Part 1 of the Welfare and
Institutions Code, shall be conducted in the County
of Butte.
a. In all such proceedings, the County of Plumas
shall furnish necessary legal counsel, or, at its
option, may request the services of the County of
$utte legal counsel which has been designated by
law or by resolution of the Butte County Board of
Supervisors as the proper legal counsel for such
proceedings.
b. Should County of Plumas option to use County of
Butte legal counsel in such proceedings, County of
Plumas shall reimburse County of Butte for such
services at the rate of $17,50 per hour, provided,
however, that where a court appointed attorney is
appointed to represent-the alleged ill person, it
is understood and agreed that the Superior Gourt
of Butte County has the sole jurisdiction to set
. fees for court appointed attorneys, and Plumas
County shall reimburse Butte County for whatever
fees are set by the Butte County Superior Court.
3. Plumas County shall reimburse Butte County for the
cost of appearances, by Butte County Mental Health 5ervic
psychiafirists, which may be required at any such court
proceeding, wherever held, at the rate of $20.00 per
hour, including travel time, plus mileage at the rate
of $0.12 per mile.
D. CONSERVATORSHIP: If, pursuant to Division 5, Part 1
of the Welfare and Tnstitutions Code, conservatorship is deemed
advisable by the Director of the Butte County Mental Health
Service, he shall so advise the Plumas County conservatorship

investigating agency. .Said investigating agency shall promptly
make its investigation, and if it concurs with the opinion of said
Director as to the advisability of conservatorship, it shall
initiate all proceedings necessary to effect conservatorship.
E. INSPECTION OF PLUMAS FACILITIES AND CONFERENCE WITH
PLUMAS PHYSICIANS: Those members of the staff of the Butte County
Community Mental Health Services, selected by the Director of said
services, shall travel to Plumas County and there inspect the
Plumas County Mental Health facilities and confer with the Plumas
County physicians concerning the services to be rendered pursuant
to this agreement.
1. In consideration of said inspection and conference,
Plumas County shall reimburse Butte Counnty at the rate of
$20.00 per hour, including travel time, plus mileage
@ $.l2 per mile.
F. ADMINISTRATIVE COST: In addition to those previously
noted costs, Plumas County shall reimburse Butte County for ser-
vices rendered by the program chief in the administration of
services pursuant to this agreement, at the rate of $1500.00 per
year.
G. BILLING AND REIMBURSEMENT OF COSTS: For all services

II provided to the County of Plumas pursuant to this agreement, the
County of Butte, or its agency providing such services shall, on
the first day of each month, or as soon thereafter as is convenient
submit to the County of Plumas a bill for the services provided
during the preceding month. The County of Plumas shall remit,
to the agency which has submitted such billing, full payment thereo
within 30 days of the receipt of such bill.
H. ADDITIONAL CONSIDERATION: It is understood and agreed
that the $20.00 per hour cost for psychiatric services referred
to herein in paragraphs A.l.a,'A.2.b, A.3.a, B.3., C.3o, and E.l
is a minimum amount, and it is expressly agreed that in the event
it is determined by an audit that the County of Butte's costs

exceed the amount stated herein for psychiatric services, then in
that event, it is expressly agreed that Plumas shall reimburse ',
Butte for said additional cost.
I. TERM: This agreement shall be for a term or period
commencing on the 1st day of July, 1969, and terminating on the
30th day of June, 1970; provided, however, that this agreement
may be extended by written endorsement of the parties hereto, and
may be cancelled by either party by-the giving of 60 days written
notice to the other party.
The addresses of said parties for the purpose of giving
isaid notices shall be as follows:

J. APPROVAL BY DTRECTOR OF MENTAL HYGIENE: The provisions
of this agreement are subject to the approval of the State of
,California Director of Mental Hygiene, anal this agreement shall
not be operative until such approval-has been obtained.
IrT WITNESS WHEREOF, the parties hereto have executed this
agreement the day and year first hereinabove written.
