RESOLUTION REQUESTING ROAD CONSTRUCTION AND
SHOP EQUIPMENT BE MADE AVAILABLE THROUGH
THE CIVIL DEFENSE SURPLUS PROPERTY PROGRAM
WHEREAS, Section 3 (b) of the Federal Civil Defense Act of
1959, as amended, defines the term "Civil Defense" to mean all those
activities and measures designed or undertaken (1) to minimize the
effects upon the civilian population caused or which would be caused
by the attack upon the United States; (2) To deal with the immediate
emergency conditions which would be created by such an attack; and
(3} effectuate emergency repairs to, or the emergency restoration of
vital utilities and facilities destroyed or damaged by any such
attack; and
WHEREAS, paragraph 203 (j) (1) of the Federal Property and
Administrative Services Act of 1949 authorizes the donation of
Federal Surplus Property exclusive of real property, for the purposes
of education, public health, or Civil Defense with no Federal priority
among the three purposes; and
WHEREAS, in accordance with paragraph (4) subsection 203 (u)
of the Act, the Director of Civil Defense is responsible for deter-
mining what surplus property, exclusive of real property, is useable,
and necessary for Civil Defense purposes; and
WHEREAS, the construction and maintenance of road and highway
systems would be of the utmost importance in national ate. local
emergencies and for construction of expedient shelters under fallout
conditions; and
WHEREAS, States and political subdivisions with large land
areas, topographical extremes, low population density and minimal
assessed valuation have difficulty in acquiring adequate road and
highway construction equipment; and
WHEREAS, existing rules and regulations are restricting
the flow of possible road and highway equipment; and
WHEREAS, it is the feeling of this Board of Supervisors.
that resources of the United States should be utilized for the
welfare and safety of the American people,
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors
of the County of Butte does respectfully request the Director of
Civil Defense, Office of Civil Defense, Department of Defense, Mr.
John E. Davis, to re-evaluate and include road and highway construct-
ion equipment and associated maintenance shop equipment in the use-
able and necessary property list of donable property for Civil
Defense purposes.
BE IT FURTHER RESOLVED that copies of this resolution be sent
to the Honorable Ronald Reagan, Governor of California, Sena for
George Murphy, Senator Alan Cranston, Congressman Harold T. "Biz.z"
Johnson, Secretary of Defense, Melvin Laird, the County Supervisors
Association of California, the United States Civil Defense Council,
and to any other interested persons.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, on the 21st day of October,
1969, by the following vote:
