BOARD dF SUPERVISORS COUNTY ` OF BUTTE, STATE OF CALIFORNIA Resolution No. 69- 18'7 RE50LUTION AMENDING RESOLUTION N0. 69-68 WHEREAS, the Board of Supervisors of the County of Butte, State of California, did on the 8th day of April, 1969, pass and adopt Resolution No. 69-68, entitled "Resolution Designating Facilities And Personnel Pursuant To Lanterman-Petris-Short Act"; and WHEREAS, said resolution designated certain physicians and psychiatrists as professional persons who might take, or cause to be taken into custody persons who are a danger to others, to themselves, or are gravely disabled as a result of mental disorders, pursuant to Welfare and Institutions Code Section 5150, NOW, 'THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That paragraph 2 of page 3 of Resolution No. 69-68, be amended to read as follows: "All physicians practicing medicine and all psychiatrists. practicing psychiatry in Butte County are hereby designated as professional persons who may take, or cause to be taken, into custody persons who are a danger to others, to them- selves, or gravely disabled as a result of mental disorders, pursuant to Welfare and Institutions Code Section 5150." On April 8, 1969 the Butte Co~.nty hoard -of Supervisors ;adopted the above referenced resolution in accordance-with-the provisions of the Lanterman-Petris-Short met. On Page 3 of the resolution, commencing on Line 5, the Board appointed."All physicians practicing medicine at the-Butte County Hospital, and all psychiatrists practicing in the Butte County Mental Health Clinic" as professional persons who m.ay.- take, or cause to be taken, into custody persons who are. a danger to others, to .themselves, or are gravely disable'ci as a result of mental disorders, pursuant to y~elfare and Instituta.ons Code .Section 510. when a person afflicted frith a mental disorder comes-into contact-.with a physician at a private hos ip tal and conc~uct.s himself in such a way as to indicate to that physician that a da~agerous~mental condition exists, the private physician is without authority to sign the neces- sary papers which enable the police to tran:s.port~the afflicted person to the County Hospital for treatment and evaluation. The police have on occasion come into contact under such circumstances with afflicted persons who exhibited symptoms in the presence of their private physician and yet, at the time the police arrived, were acting normal- ly and the police were without probable cause to take the afflicted person into custody. I have discussed the ;matter with Dr. Gerald Maguire, Director, Butte. County.Mental Health Services,. and we have written a joint letter to the Butte-Glenn Medical Society inquiring as to the 'Society's posi- t.ion if the Board were to designate all physicians practicing in this county as persons authorized to take into custody, or cause to be taken into custody individuals who,.as a result of mental disorder - are a danger to themselves or others. A copy of my letter to Col. Ra~deout is .attached hereto as Exhibit A. The Butte-Glenn Medical Society conslder.ed the problem and on October 25, 1969 sent me a letter in which they recommend to the Board of Supervisors of Butte County that the Board designate all physicians practicing medicine in Butte County as persons authorised to cause to be taken ,into custody individuals who are a danger to others or to themselves as a result of a mental c3isordar and to sign ~r - ,. ~ !r _. ~~~ Daniel V. Would you please. prepare an amended. resolution to that effect so that it can be presented to the Board for their action. At such time as the amended resolution is presented to t'he Board, I would be happy to appear before them and explain in mare detail the probi'em as it has been presented to me by the.poiice agencies of this county.
