ORDINANCE N0..___6Q2 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIF'ORNTA, PURSUANT TO ORDINANCE NOSa 475 AND 522 OF SATD COUNTY The Board of Supervisors of the County of Buttefl State of California, under and pursuant to Ordinance No. 475 of said County as amended by Ordinance No. 522, do ordain as follows SECTION le The hereinafter described area situate in the County of Butte, State of California, shall be and is hereby zoned as an °1M-111 (Light .Industrial) District as hereinafter described and subject to all of the restricted uses applicable to the uses of an "M-1°' District, said area so zoned being located in the unincorporated area of Butte County, south of the City of Chico, particularly described as follows; Property bounded on the West and East by the Southern Pacific Railroad Right-of-way, on the North by Edgar Slough and on the South by Hegan Lane; excluding therefrom that property owned by Nathan H, Thomasson, Assessor Paroel Noo 39-G6-3, reoord of the County Assessor on March ~, 1960, SECTION 20 '171e following restrictions shall apply in an "M=1" (Light Industrial) Districts 2.1 Uses permitteds 1) Uses permitted in °iC-1" and "C-2" Districts. 2) Wholesale and storage warehouseso 3) The assembly and storage of goods, materials, liquids and equipment (except the storage of inflammable matter or explosives or materials which create dust, odor or fumes)o 4} Feed storehouses and warehouses and fuel yardso 5) The manufacturing, processinge fabricating9 assembling, refining, repairing, packaging and treatment of goods, materials and products by power (oil, gas or electric), including, by way of example and illustration, but not limited to, the manufaoturing, fabrication and assembling of bathroom shower and patio partitions, enclosures and doors, windows and store fronts of aluminum, plastic and fibea°glass9 or other suitable material, and the processing, finishing, polishing and anodyzing of aluminum extrusions and castingsg EXCLUDTNG AND EXCEPTING, however, operations involving fish fats, oils, bones and meat products or similar substances, commonly recognized as creating offensive conditions in the handling thereofo 6) Dyeing and rug cleaning plants, veterinary hospitals and animal shelters and boarding kenneis9 cabinet and woodworking shops, construction and material yardsa 7) The following uses when conducted within a building or enclosed by a solid masonry or metal wall or fence, not less than six (6) feet i.n heights Body and fender repair shops, auto painting shops, bottling works, sheet metal shops, welding shops, truck terminals, truck service and repair stationsn building material yar~.s and contractor°s stoz°age yards. 8) Signs appurtenant to any permitted uses, and billboardse 2.2 Building Site Area Requirementss None, except as may be required for building and for off--street loading area and parking space as set forth below under °Loading Area° and °Parking Space°o 2.3 Maximum Height of any building or other structured Sixty-five (65) feet. ~~i 2.4 Yards Required:. 1) Front Yard: One-hundred (100) feet from centerline of existing road. 2) Side Yard: None, except where the side of a lot abuts an "R" District, in which case the side yard shall be not less than ten (10) feet. 3) Rear Yards None, except where the rear yard abuts an "R" District, in which case the rear yard shall be not less than ten (10) feet. 2.5 Loading Area: Private off-street loading space for the handling of all goods, materials and equipment shall be provided. 2.6 Parking Space: One parking space for each three (3) employees, or one parking space for each two thousand {2,000) square feet of gross floor space., whichever is greater. 2.7 Any use for which a Use Permit is required in an "A-2" District, upon "application for and granting of a Use Permit. SECTION 3. All uses of land within the District not specifically authorized and permitted under Section 2 are prohibited. SECTION ~. Penalties for any violation of the zoning hereby imposed within the District shall be as provided in the Zoning Enabling Ordinance, and in compliance with the provisions of the Zoning Enabling Ordinance this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. In compliance with the provision of,said Zoning Enabling Ordinance the same is hereby amended by adding to Section 5 thereof this Ordinance in full. SECTION 6. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (ls) days after its passage this Ordinance shall be published once with the names of the members voting for and against it in the Chico Enterprise -Record , a newspaper published irc the County of Butte, State of California.
