AN INTERIM ORDINANCE ESTABLISHING REGULATIONS FOR
THE USE OF LAND AND THE CONSTRUCTION AND USES OF
BUILDINGS WITHIN THE PARADISE IRRIGATION DISTRICT
4.1
The Board of Supervisors of the County of Butte, State of California, do
2 ordain as follows:
3 SECTION 1. NECESSITY. The Board of Supervisors finds that certain regu-
lations are necessary for the preservation of the public health, safety, con-
4 venience and general welfare, pending the conducting,of studies and surveys and
the preparation and adoption of a Comprehensive Land Use Plan for the County of',
5 Butte, and hereby adopts certain such regulations of an interim nature as set
' forth below:
6 SECTION 2. REGULATIONS:
~ 2.1 The provisions of this Ordinance shall apply to all properties lying
$ within the Paradise Irrigation District, excepting therefrom all areas that
have already been detail zoned by the Board. of Supervisors under County
9 Ordinance Nos. 487, 508, 548, 619, 623, 627 and 691.
' 10 2.2 Uses Permitted: The following uses are permitted within all parts
of the District:
11 A. Lawful uses of land now established.
', '12 B. Dwellings and accessory buildings.
C. Agricultural uses and buildings.
13 2,3 Use Permit Required: No new commercial buildings, industrial uses of
1~ land or buildings, public or quasi public uses including schools, churches,
public buildings, public utility buildings will be allowed without first sec~.r-
!15 ing a Use Permit approved by the Planning Commission and Board of Supervisors.
16 SECTION 3. ADDITIONAL REGULATIONS:
' 17 3•I The following regulations shall apply in all parts of the District:
Z$ A. Building Setback Lines Required: No building or structure shall
hereafter be located within the District closer than fifty (50) feet fxom
19 the centerline of existing County road; this section shall ,not apply to
public utility transmission lines, mains or other transmission facilities.
20 B. Minimum Building Site Required: Each single family residence
21 shall be located on a site not less than eight thousand, one hundred and
twenty-five (8;125) square feet; and said residence shall be located not less
.22 than six (6) feet from the side line of the building site.
'23 C. Minimum Building Site ~didth Required: Sixty-five (65) feet.
24 3.2 In cases where compliance with the provisions of this section will
result in undue hardship, a variance may be approved in the manner prescribed
25 for the handling of a Use Permit.
!26 SECTION 4. USE PERMITS:
'27 4.1~ Application for a Use Permit shall be made to the Butte County Plann-
ing Commission and such application shall include a'description of the request-
28 ed use and shall be accompanied by plans showing the location of proposed
buildings or proposed alterations, locations of driveways and parking areas,
29 advertising structures and other information as may be required by the Planning
Commission.

4.2 The findings and recommendations of the Planning Commission shall be
submitted to the Board of Supervisorso
~..3 Any person not satisfied with the final action of the Board of Supervisors
may, within ten (10) days thereof, appeal in writing to the Board of Supervisors.
A copy of such appeal shall be submitted to the Planning Commissiono Said Board of
Supervisors shall render its decision within sixty (60) days after the date of the
filing of such appeal.

A. In any oase where the oonditions imposed by the Use Permit have not
been complied with, the Planning Commission shall give the permittee a ten (10)
day notice. If, at the end of said ten (10) day period the permittee still
fails or refuses to comply with the provisions of the Use Permit, the Planning
Commission shall have the right to reoommend to the Board of Supervisors that
said Use Permit be revokedo
B. In any case where a Use Permit has not been used within one {1) year
after the date of the granting thereof9 the Use Peam it shall be automatically
null and void.
4.5 The Planning Commission shall hold public hearings as prescribed by law,
SECTION 5. VIOLATIONSo Any person violating any of the provisions of this
Ordinance is guilty of a misdemeanor.
SECTION 6. EMERGENGYo Far the immediate preservation of the public peace,
health and safety of the area hereina~bove described and the residents and in-
habitants thereofs it is necessary that this Ordinance take effect immediately.
A declaration of the faots oonstituting the necessity therefor is as follows:
The adoption of sueh interim zoning plan is necessary a.n the public

SECTION 7. EFFECTIVE DATES This emergency ordinanoe shall take effect
immediately upon its passage and before the expiration of fifteen (15) days and
after its passage shall be published once with the names of all members voting
for and against the same in the Paradise Press , a newspaper published
in said County of Buttee
PASSED and ADOPTED by the Board of Supervisors of the County of Butte, State
of California, on the 20th day of February , 1961 by the following
vote;
