WIIII~.EAS, Ordinance No. 981 establ~.shes a procedure for the creation of ~
underground u~ilz~y districts and r-,:quires as the initiai step in such procedure
the holding o~ a pti.blic hearzng to ascertain whether p~blic necessity~ heal~h~
safety or welfare requzre the removal ofi polesj overhead wires and associated
ov~rheacl structures and the underground instal.~ation of wires and facilzties
~'or supplying electric, communication~ or s~m~lar or associated service in any
such distr~.ct; and
W13ERF~A,S, it has been recommended ~ha-~ such an underground utiZi~y
district, hereinafter cal~.ed District~ be formed on Pearson Road £rom the
centerline of Skyway to the centerline of Scot-~wood Road and bounded by a line
100 feet each sid.e of the centerline of Pearson Roac1.
NOW, TFiEREFORE, BE TT RESOLVED AS ~'OZLOWS:
l. Notice is hez~eby given that a public hearing will be helfl by ~the
Board of Supervisors of -~h.e Count~r of Butte on l~ia,rch 3rd ~ ~~~~
at ~the hour of ~~;00 g.m. in the Board of Supervisors Room of the Courthause~
Oroville, California~ to ascer~azn whether the public necessity~ health~ safety,
or welfare require the removal of poles, overhead wiz~es and associated overhead ;
stz~uctures and th~ underground installation of wa.re and facilities for s~u.pplying
electric~ communication, or similar associated service in the Dis-~rict herein-
above described.
2. At such hearing, a11 persons in~erested shall be g~.ven an opportsni~y
to be heard. Said heax~.ng may be continued from tiuie to time as may be determin
by the Board of Supervisors.
3. ~he County Clerk sha11 no~ify all affected proper~Ey ownexs as shown
on the 1.ast equalized assessmen~ roll and utilities concern~d of the time and
place of such hearing by ma.iling a cogy of ~his resolution to such proper~y
owner s and utilities concerned at least ten (10) days prior to the da~e theraof.
