RESOLUTION AND ORDER VACATTNG PUBLIC UTILITY
EASEMENT IN ACCORDANCE WITH SECTION OF
THE GOVERNMENT CODE
WHEREAS, the owner of ~he prope~ty located in 5harp
Subdivision has r~quested the vacation and abandonm~nt o£ that
partion of a pub~ie u~iZi.ty easement hereinafter described, and
WHEREAS, the Notice of Inten~ian to Vacate Caun~y Easement

was dLa.ly pubJ.ished and posted, and hea~ing was du~,y held on
February 2~, 1970, at the hou~ of lI o'clock A.M., and no person
appearing to object ta ~he same, and
WHEREAS, Pacitic Gas and Electric Company,.Pacifie Telephone
and Telegraph Co~npany and the California Wat~r Service Company have
i~dica~ed ~hat they are not now, ~.or do they in the future, in~end
to use:~saa.d public utility easement, and
WHEREAS, ~he Pl.anning Co~nmission of ~he Courity of Bu~te,
to whi.ch said petition was refErred, has recomtnended ~he vacation
and abandonme~.t of said easement, and
WHEREAS, said easement was es~ablished and deda.ca;~ed on
Septe.~nber 19, 19&3, by recordata.on o~ that certain subdivision
enti~~ed "Shaip 5ubdivzsion" in B001C ~~. of Maps, a~ pages 7 and 8,
Records af the Coun-~y af Butte, and the easement was not used
continuously since that date.
NOW THEREFOR~ BE IT RESOLVED AND ORDERED by the BOARD OF
SUP~RVTSORS ~F THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as ~ollows:
1. That the h~reina~'tex~ described gub~ic utility easesnen.~
was no~ used continuous~y s~nce the date of'its dedica~tion and that

3. That said public utility easement is situa~ed in the
County of Butte, State of California, and described as ~ollows,
to wit:
The Northwesterly Three (3) fee~ of Lot 1.5 as shown
on that certain Map entirled, "SHARP SUBD~VISTON ",
which Map was recorded in the office of the Recordex
of the County of Butte, State of Cali£ornia, on
September 19, 1963, in Book 31 of Maps, at pages
7 and 8.
4. That this Order of Abandonment and Vacation of Public
Utility Easement is made in accordance with Section 50G.43 of the
Government Code and the Clerlc of this Board, in accordance w~.th
Section 50445 of said Code, sk~a11 cause a Cexti~ied copy of thzs '
Order, attested by sai.d Clerlc under seal, to be recor.ded in the
Office of the Recorder of the County of Butte.
THE ~'OI2EGQING ~2esolution and Order was duly PASSED AND
ADOPTED at the regular meeting of the Board of Supervisors of the
Caunty of Butte, State of California, on the 24th day of February,
1970, by the following vote:
AYES: Supervisors Howsden, Maxon, McKillop, Reynolds
and Chairman Dunaway

ABSENT: None
