1~ WHEREAS, by resolution daYed February 10, 1970, a pubJ.~c hearing was
5 called for on March 3? ].970, at the hour of 11:00 A.M., i.n Che Board of
g Supervisors Room in ~he Courthouse, Oroville, Cal.i£ornia, to ascertain whether
7 ~he publ.ic necessity, hea].th, safety, or welfare requires ~he remova]. of poles,
$ ove~head wires and assoca.ated overhead structures, and the underground instal-
g 1a~ion of wires and facilities ~oz supplqing electric,communication, or
~p similar oz associated service, within that cer~ain area of the county descxibed
11 as foJ.l.ows:
12 East Avenue from 200 fee~ west of Cohasset Road to the centerline
13 0~ Pillsbury Road and bounded by the existing ri.ght o~ r,~ay lines
L4 0~ East Avenue; and
~5 WHEREAS, noti.ce of such h.eari.ng has been given to alJ. affected property
16 owners as s~ach are shown on the last equalized assessmen~ ro1J. and to aIl
lq uCilities concerned in the mannex and within the time requixed by iata; and
~g WHEREAS, such hearing has been duly and regulariy held, and all persons
~g~ interested have been given an oppor~unity to be heard,
2p NOW~ THEItEFORE~ BE IT RESOLVED by the Board of Supervisors of the County
2I of Butte, that, pursuan~ ~o Ordinance No. 981 of tha County of Butte, the
22 above-described area is hereby declared an Undergxound Utility Di.strict, and
23 is designated as ~asC Avanue Underground Utilitiy District No, J. of the County
24 of Butte. At~ached~ hereto, and hereby incorporated as a par~ ot this resolu-
~5 tion, is a map del.inea~ing the boundaries of said Distra.ct;
2g RESOLVEDa FUR'~HER, that the Boazd of Supervisors does hereby fix
27 Jul.y 1, 1970~ as ~he date on which a~~ectied property owz~exs must be ready
28 to receive underground service, and does hereby order the,removal of aTJ.
2g poles, overtzead w~.xes and associated overhead structures and the undergxound
3p installation of wires and facilit~es for supplying elactiric, communicat~on, or
31. similar or assoc~.ated service wi.~.hin East Avenue Underground TJtility District
32 No. 1 on or before July 1, 1970;

1 R~SOLVED~ ~URTH~R, that f.he County C~.erk is hereby instructed ~o notii~y
2 a11 affected utiJ.zt~.es and all persons own.in.g real property within East Avenue
3 Underground Utili~y District No. I o~ the adoption o~ tha.s reso~uCion within
4 ten (10) days after the date of such adoption. Said Co~nty Clerk shaZl
~ further notify said property owners of the necessity that, if th.ey or any
6 person occupying such pzoper~y desire to continue to receive eJ.ectxa.c,
7 communication, or other simiLar or associ.ated service, they or such occupant ~
$ shall, by the date £ixed in this resoJ.ution, provide all necessary facility '
9 changes on tiheir premises so as to recei.ve such services from the lines of
~,p the supplying utility or utilities at a new Iocation, subject to applicable
],]~ xules, regulations, and tariffs of the respective uti~].i.~q or utilities on
~,2 £i.7.e with the Public Utilities Commission o£ the State of Cali~ornia. Such
13 no~ification sha11 be made by mailing a copy of ~his xesolution together with
14 a copy of said Ordinance No. 9$1, to all affected property own~rs as such
