BUTTE COUN'I'Y, CALI~OF2NIA BE IT RESOF~VED by the I3oard of Supervisors of the County of Iiutte, State of CaLifornia, that it is the intentian of said Board of Supervisors to order the fo2l.owing improvements to be made in Sierra Del Oro ~states Unit No. 4 Assessment District, Butte County, Califnr- nia, to wit: The construction of streets, roadside and outfall drainage dztches, and drainage gipes, together with a11 necessary inlets, manholes, barricades and other appurtenances within the boundaries of said proposed district; Excavation to improve the sight distance at the southeast corner of the intersection of the Skyway and Rosewood Drive; Installation of a corrugated metal pipe culvert under the Skyway, 250 feet north of the intersec- tion of the Skyway and Rosewood Drive. All of the above mentzoned work is more particularly and specifically set torth and described in the plans, profiles and specifications for said work heretofore adopted by the Board of Supervi- sors of the County of Butte, by its Resalution No.70-31 , which plans, pro£iles and specifications are hereby referred to for all particu- lars in connection therewith. The public streets and rights-of-way hereinabove referxed to are shoivn and delineated in detail and speci£i- cally ~ocated on the plans hereinabave re£erred to; BE I'I' FIIRTHER RESOLVED that the impxovemes~ts be constructed in said streets, avenues, roads, lanes, rourts, places and/or public ways hereinabove descri6ed, of the dimensions, materials and in the particular locations set forth and shown on the plans and specifica- tians and de~aiZed drawings hereinabove and hereafter referred to; together with the construction of all appurtenances thereto, inciud, ing necessary fittings, trenchings, grading and regrading, ex~ava~ion -1- ~~~~`~,~{~~~p~ ,~. a>'~ ~;`;~,`~`'~~ ~~~"~ _ _ ~~ ~I ~ ~ . and fill, removal of obstructians, connections to existing services, back filling, reconstruetion of existing ground surface as re~uired to conditions existing prior to commencemer~t of construction, a12 in the ~anner, of the materials, and to the di~ensions and to the grades, and in the particular locations as the same are more fu11y shown on the plans and specifications and detailed drawings h~reinabove and hereafter referred to; ~ That the structures and work and improvements herein described shall be constructed to the grades, sub-grades and elevations sever- ally shown upon the plans and profiles and detailed drawings there- of in the respective locations thereof, to which plans and profiles re£exence is hereby expressly made for a description of the grades to which all of the work and improvements under this Resolutxon af Intention shall be done, which said grades are hereby adopted and estab- lished as the official grades therefor for all purposes in connection with proceedings pursuant to this Resolution of Intention; notice is hereby further given that said grades are or may be, in part, new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels; The plans and specifications, pro€iles and detailed draw- ings and diagrams accompanying the same are hereby expressly referred to for fu~l and detailed description and location of said proposed work and improvements, the public streets and rights-of-way involved, and the grades of the public streets and rights-of-way involved, and of the grades to which said improvements are to be constructed; Excepting from all of tHe herein described «ork all of said wqrk that has already been done to the lines and grades shown on said plans and pxofiles, and in accordance with said plans and speci£ica- tions; All of said tiuork shall include, without duplication, any and aIl street intersections, termznations and opposite terminations occurring within the limitations of said wark; ` -2- ' __ _.._._..:.,.___.... ~___._.._. ___..___. ...__".,__ "___...__.___ ___.......-~.. ._ ......... .............:.. _..__~_ ____. "_.._._.:.__ ._"___._.. _____ ._._ .. .,. ..._..,.,F_:.__-__ . . . : - . . .. ~~ i~ ~ ~ . . • The attent~on of aIl persons is directed to the fact that all of said classes of work above described may not be construc~ed upon all of the stxeets and/or puhlic ways above described in their entirety, but only upon the particular locatians as shown_on the plans and specafications; BE IT FURTHER R~SOLV~D that the Board of Supervisors of the County of Butte hereby makes the expenses and costs of said imprnve- ments chargeable upon a district, which said district sazd Board of Supervisors hereby deciares the district benefited by the improvements -herein described; said district shall include t~at territory in the County of Butte, State of California, which is shown on that certain map on file in the office of the County Clerk of the County of Butte, and which is entitled and described, "Proposed Boundaries of Sierra Del Oro Estates Unit No. 4 Assessment District, Butte Caunty, Califor- -nia,"-and evhich said map indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area tia be assessed; said map is, by this refer- ence, incorporated herein and made a part hereof, Excepting from the area shotan and delineated on said map hereinabove referred to, the area of all public streets, avenues, lanes, roads, drives, courts, places, public parks, and aIl easements and rights-of-way therein contained belongzng tq the public, and also exc~pt- ing £xom the area shown and delineated on saxd map a11 property owned -"~by the United States of America, the State of California, the County of Butte, and any other public agent mandatory of the Government, s~hool board, educational, penal or reform institution or institution fox the feeble-minded ox the insane which is in use in the performance of a public fUnction, and also specifically excepting thexefxom any property belonging to the United States of America or the State of California, ~rhether in use in the performance of a public function , or otherwise. -3- NOTICE IS H~RE~Y GIVEN that serial bonds to represent un- paid assessments, and bearing interest at the rate of seve~ per cent`' (0%) per annum, shall be zssued in the manner and form provided in Part 5, Division 7 of the Streets and Highways Code of the State of California, (Improvement Act of 1911} to represent unpaid assessments of Fifty Dollars ($50,OD) or over, the last insta~lment of which bonds shall mature fourteen (14) years from the 2nd day ot January next succeed- ing the next September lst following their date. Said bonds shall be payable to bearer, and may be redeemed as provaded in the Improve- ment Act of 1911, and there shall be added to the redemption clause in said bonds the following words: ". ..COgether with a premium of five per cent (5a) of the unmatured principal." '-- In case o£ de~au~t, there shaZ~ be added. to the defaulted amount one per cent (10) of the amount thereof, and on the 1st day of each month follawing such de£ault there shall be added a further penalty of one per cent {1~) of such defaulted amount. The one per cent (la) penalty first imposed shail be retained by the Treasurer as a cost of servicing the delinquency and all subsec~uent penalties shall be paid to the holder of the bond along with and as a paxt of such defaulted payment. NOTICE IS HEREBY GIVEN that the o~;ners of more than si.xty per cent (60v) of the area of property within the above described dzs- trict to be assessed to pay for th~ cost and expenses of said work have petitioned this Board of Supervisors far the doing and perform- ance of said work and therefore the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 does not apply to these praceedings. Proceedings for all work sha11 be ~aken pursuant to the Improve- ment Act o~ 1911, and th~ bonds hexeinabove described shall be issued under the provisions of Yhe Improvemen~ Act of 191I as heretofore de- scribed. ~ lli i f -4- ---- -- --- _ ___ ---- -- _ _ _ _..... -- -_ . _-__ _ ~_.~ _..._._ .----.. ~ - ~1 ~I NOTICE IS HEREBY GIV~N that on Tuesday, the 14th day of Apri~, 1970, at the hour of~9:00 o'clock A.M, of sai~ day, at the meeting place of the Board of Supervisors of the County of Butte, --lacated in the Bu~te.County Courthouse, Oroville, California, any and all pexsons having any objec~ion to the propnsed improvements to be made, or any objections to the grades to which said work is pro- posed to be done, or to the boundaries of the d'zstrzct proposed tio be assessed to pay the cost and expenses thexeof, may appea~ before said Board of Supervisors of the County of Butte and show cause why -said improvements should not be carried out in accordance with this Resolution of Intention, and may present written protest, not later than the hour hereinabove set for hearing, against the doing of said woxk, the grades to which said work is to be don~, or the extent of the territory to be assessed to pay the cost and expenses thereof; - The County Clerk of the County of Butte shall cause this Resolution of Intention to be publ~shed twice in the CHICO ENTERPRISE, a newspaper o£ general circulation, circu~ated 'zn the County of Butte, which said newspaper is hereby designated as the newspaper in which shall be printed and published ail notices, resolutions, oxdexs and o~her matters required to be published 'zn the pxoceedings taken pur- suant to this Resolution o~ Intention and under the prov~sions of said improvement Act of 1411, and amendments thereto; the first pu~lica- tion of said notice shall be not less than ten (10) days prior to the date herein fixed for hearing on this Resolution of Intention; The Engineer of Work shall cause to be conspicuously posted along the line of said contemplated work and improvement, and on all the operi streets -aithin the assessment dis~rict, notice ot the passage of this Resalution of intention in the time, form and manner required by law, The County Clerk of the County of Butte is hereby directed to mail a copy of this Resolution o£ Intention, postage prepaid, to -5- _ _ __ _ __ ___. __ _ . , ___ _ ~ 1 ___ ___ ~~ ~ ~ . ~ ~ .. ~~ .. , . .d all persons owning real property proposed to be assessed, wliose names and addresses appear on the last equalized assessment roll or as known to said County Clerk, said mailing to be at least fifteen days prior to the day herean fixed for hearing on this Resolution of Intention, all in the time, form and manner prescribed in said Improvement Act of 1911, as amended.
