Butte on the 14th d2y of October, 1969, adopting a resolution
making application to the State of California Department of
Finance for funds for the repair and restoration of roads,
streets and bridges pursuant to provisions of the Emergency
F1ood Re1ie•~ Law, Sections 5415~-54164 of the Government Code;
and
WHEREAS, the work covered by said application has
been investxgated by the Sta~e of Calif~ nia Department of
Public Works and a report thereon filed with the Department
of Finance and said repork has been approved by the Director
of Finance; and
WIiEREAS, it is necessary and expedient that COUNTY
OF BUTTE enter into an agreement with said DEPARTMENT OF PUBLIC
W~RKS with reference to performance and finan.cing of sai.d
, work and other matters related thereto;
NOW, THEREFORE BE IT RESOLVEI3 by the Board of
Supervisors of the County of Butte that the County enter into
an agreement with tlze said Depar~ment oft Publi.c Wo~k.s, a copy
af which agreemenC is a~~ached h.ereto; and
BE IT FURTHER RESOLVED, that Chairman of Board of
Supervisors is hereby authorized to execute said agreement
in the name of County of But~e.

Z2. Perfarmance of ~rrork.
A. Performance of work by the Local Agency:
l. When so specified in the Con'~rac'~, ~he Loca~ Agency will
_perform the work or any item.thereof, ar award ~he Con-
tracts th~refor pursuant ~o the laws governin~ the Local
Agency. All public works cons~tructi.on can~racts awarc~ec3
by the Local Agency for repair and restaration prajec~s
financed hereunde~ shall. incZude ~he "Fair Emp~aym~n~
Prac~ices" pxovisions here~o attached as ''Appendi,x 1,"
or nondiscriminat~.on provisi~ns pursuan't to app~icable
Federal requirements. It sh~.ll be the responsibiZity
of ~he Local Agency to insure compliance wi~h said pro-
visions. Capies of ~he necessary ~orms may be procured
upon reques~ ta ~he Department of Pu.blic Work~, th~ De-
partment of General Services, ar the D~par'tment af Wa'~er
Resources. The Loca~. Agency sha~l rende~ ~o the Depar~-
ment monthly, or at such ~nterva~~ as are satisfactory
to the Departmen~, claims, in such form as ~he Department
prescribes, cover~ng the cost of the work performed.
Thereupon the Sta~e wzl.l reimburse the Lncal Agency for
the value of the work performed, to the extent of the
5tate's propartionate share ther~of, ~.n ~he ratio set
forth in the con~ract, le~s ten per cen~ (3.Q~} of said
sum which w~ll be re~ained by ~he ~tate for f~.nal a.dj~zs~-
ment as ~o the amoun~ of the State and Loca1 Agency con-
~r~bu~tion in accordance with ~he prov~.sions of Ar~icle
ZII(A) hereof.
2. C~aims for reimbursement wzll be certified by an author-
ized representa~ive of the Loca3. Agency or by a s~.gna-
tory ~o ~the Agreement on behalf of the Local Agency.
Wi,thin sixty (60) days after completion of ~he wark called
for by this Agreement, ~he Loca~ Agency sha1~ fi1.e wi~h
~he Department a final. report of expenditures th~a^efor
~n the forna prescribed by the Department. The fir~al pay--
ment wi11 be made subject to the adjus~men~s hereinabove

5. Uss of Eq~ipraent.
Where work is per~'ormed by the Local Agen~y with its
own forces, equipment owned by the Loc~1 Agency and
u~ed on the work mayy for the purpo~ES of progress
payment c3aims, be charged in accordance w~.th the
Local Agencyts normal cost distribixtion procedure
or in any manner that w~.ii dis~ribute a fai.r and
equitabl~ sl~are of ~he aver-a1.1. equipmen~ deprecia-
~ion, ma~ntenance and operating expense to each pro-

B. Performance of Work by the Deparvmen~t:

E. The Department may, wi~haut the necessity of amending ~he
Agreemen~, ad~ust the eost estimates of item~ of work
financed hereunc~er wi~h~n the monetary lim~ts of the Agree-
men~.
F. ~n the even~ ~he Department, at any ~ime, should detErmine
that any portfon of the Stia~e funds prov3.ded in the contrac~
are ~n excess of need ~'or the completion of ~he work, and
so not~f~.es '~he Local Agency, the excess funds w~ii be re-
turned '~o the ~'und from which al.~ocated and w~.11 no longer
be available ~'or expend~.ture hereunder, unl.ess realloca~ed,
G. ~n. the event any work financed hereunder sha~1 b~ aceom-
pl~.shed in a manner wh~ch a~lows ~he salvage of any mater-
~a7.s f'ram ~he damaged facility, ~he reasonab~e vaZue of
such sa~.vageab3.e ma~er~als shall be appli.ed to reduce ~he
tota~. cos~ o#' such work. The xeasnnab~.e va].ue o€' such
salvageable materiaJ.s sha11 be the amount rea~.~.zed by th.e
Loca7~ Agency from ~he sale thereaf upon compe'tit~ve bid-
ding therefor, or in the absence of such sale, such amount
as ~he Departmen~ may de'term~.ne ~o b~ reasonable value
thereof'.
H. Notw~ths~a.nding any o~her prov~sions herein con~ained the
Departr~ent may at any time re~ain such funcis addi~ional
~~o ~he 10~ re~entior~ provided far in Ar'~icle I~ hereof as
i.t may deem neceasary to prevent an overpaymen~ of the
State's eon~r~bu~ion ~oward the work f~nanced hereunder.

A. ~n thE event that any i~em of the work covered by this
