That the applicaat i.s a political subdivision of the Statie of Ca3.ifornia. 2. That the post office address o£ the appli.cant is: Department of Public Warks, 7 County Center Drive, Oroville, California 95965. 3. That the applicant hereby requests authori.zatian to construct two public road erossings of the railroad right of way of the Western Pacific Company. 4~. That the County of Butte and the Western Pacific Company are agreed upon t[~e allocation of costs of improvement and installation of protective devices at said crossings. Such allocation should be made in accordance with the letter received from Western Pacific Coinpany attached hereto as Exhibit "B", and incorporated fierein. ~ Maintenance costs of signals at said crossing are to be appor~ioned in accord- ance with and pursuant to the provisions of SecCion1202.2 Public TStilities Code and the Countyrs liability; therefore, sha11 be limited ~o such funds as are set asa.da £or allocation to the Commission pursuant to Section 1231.1 Public Utilities Code. 5. Attached, hereto, and ~narked Exhibit "A" are a map and plan ~3 sheets) which shows accurately the location of the proposed crossings, a vicinity map of the area adjacent to the proposed crossing~ and a profile showing the grade of the proposed highway across the rails at the proposed crossing, all in accordance with and to the scale required in subdivisions (f), (g) and (h) of Rule 30 of Ruies of Procedure. -2- . . . . (continued) Wherefore, ~he applicanti, pursuant to Sections 1201-7.205 of the-Public Utilities Code~ respectifully requesCS Che order or orders of this Honorabl.e Commission as follows: (1,) That the Commission authorize the construction of crossings across Western Paci.f[ic Company's rights of way at grade as proposed herein; (2) That the Commissa.on author9.ze the allocation of costs of imprnvements and installation of protective devices~at sai,d crossings~ as described above; and (3) That the cost of maintaining each and every proCecti.ve device determined to be requised ae ~he proposed crossing be apportioned in aceordance with and pursuant to the provisions of Section 1202.2 Public Ufilities Code and the County's liability therefoxe sha11 be limited to sucE~ funds as are set aside for allocation to the Commission pursuant to Section Z231.1 Public Uti.~ities Code.
