ABANDONMENT ANb VACATION
OF EASFMENT
WHEREAS, thfs Board accepted a certain grant of
easement dated January 14, 19b5, covering property situate
in the County of Butte and more particularly descriUed in
the said grant of easement, whicfz is recorded in Book 1402,
Page 24, Official Records of the County of Butte;
WHEREAS, the easterl.y 25 feet of said easement is
no longer necessary;.
WHEREAS, the present owner of the real property
under which said easement runs, to wit, ~gene Butler is
desirous of obtaining this abandonment and vacation of
easement and is willing to reimburse the County of Butte in
tize amount of $790,00, which represents the pro rata share
of the original cost of said easement to the County of Butte
paid to 1`4r. Butler's predecessor in, title;
NOW, THEREFORE, BE IT RESOLV~A by this Board of
Supervisors:
I. That the eas~erly 25 feet of th.at certain grant of
easement as recorded in Booic 1402 at Pag e 24 of the Official
Records of the County of Butte, is hereby vacated and abandoned
pursuant to the authority found in Government Code Section 25367,
upon payment to the Covnty of Butte of ~he afoxementioned $790.00.
2. The remaining 20 feet of the easement described
in Sook 1402 at Page 25 0~ the Of~icial Records o~' the Covnty
of Butte, shall continue in full force and effect including
a11 terms and conditions set forth in said grant of easement.
