No. 70=~5 wherein the hearing on the report of the nirector of
Public Works was set for ~~ y 19, 1974, 11:00 a.m., pursuant to the
provisions of the Streets and Highways Code Section 3870 et seq,
WHEREAS,said hearing has been duly held and no objections
to the report by the Director of Public Warks on file in the Office
of the Butte Caunty Glerk having been made,
WHEREAS, copies of Resolution 70-45 were duly posted
pursuan~ ~o Streets and Highways Code Section 58~1 and 5877,
WfiEREAS, the property owners listed herein had previously
filed a petition with the Board of Supervisors requesting the curb
and gutter work be performed, wherein said owners waived their
right to construct said improvements and fu'rther waived their right
to protest under Section 5878.1 of the Stree~s and Highways Code,
which petition was filed with the Board of Supervisors on October 14,
~969.
WHEREAS, on October 14, 1969, minute order 69-1~40, this
Board established the interest rate for payment of the assessments
at the rate oF 6.25 percent.
NOW, THEREFORE, BE IT RESOLVED:
l. That the real property descriptions, the names of
the assessed owners and the assessrnents are nereby
established as set forth in Exhibi~ "A" which is
attached hereto and incorpo~ated herein as if fully
set fo~~h herein, pursuant to Stxeets and Highways
Code Section 5883.

RE50LUTION AFFIXTNG ASSESS~IENTS PURSUANT
TO STREETS AND HIGHWAYS CQDE SECTI~N 5883
2. That the interest rate on said assessments is hereby
set at 6.25 percent per annum.
3. The Director of Public Works is directed to forthwith
f~le and record the notices of lien provided for
in 5treets and Highways Code Section 589~.
4. The annual equal assessments shall be in the mznimum
amoun~ of $50.00, provided further that said in-
stallmen~s shall not extend ~o rnore than five (5) ;'
years for repayment pursuant to Streets arrl Highways
Code Section 5895.
5. The liens established herein may be paid prior to
June i, 197~, and each yea~ thereafter on June 1,
at 6.25 percent interest per annum computed from
June 1,.1970, provided f~rthex however, that in the ~
event any installment due on June 1 is not paid by'
the following August 15th, then the amounts due
and payable to that date shall be entered on the
secured tax role of this county relating to the
subject parcel and shall be collected at the same
time and same manner as ordinary county taxes are
collected pursuant to Streets and Highways Code
Section 5$94.
