HomeMy WebLinkAbout70-086RESOLUTION AMENDING COUNTY OF BUTTE BUSINESS LICENSE FOR CONDUGT, OPERATiON AND MAINTENANCE OF COMMITNITY ANTENNA CABLE TELEVISION SYSTEM WHEREAS, the Board o~' Supervisors ot the County of Butte has heretofore issued a Business License, dated September 1., 1964, to conduct, operate and main~ain a community antenna cable tele- vision system within Butte Coun.~y, California, to Standard Radio and Television Company, a corpora~ion, and has duly approved its transfer to State TV Cab1e, a corporation; and WHEREAS, said Business License was issued on all ofi the conditions set forth in th.e Code of the City of Chico, Cal.ifornia, 1958 edition, as amended, in certain designated sections thereof ~ogether with certain designated sections of Chico City Ordinance No. 794, with appropriate substitution of langu.age, which City Code and Ordinance sections were incorporated therein by reference as conditions of said license; and WHEREAS, the grantee now requests that said business license be amended in part in order to incorporate by reference the provisions of certain ordinances adop~ed by the City ot Ch~.co subsequent to the issuance of said business license; and WHIIZEAS, this board finds that said request is reasonable, an.d should be granted, NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, Sta~e of California, as follows: 1. Tha~ Paragraph 1 of the Business License, dated September 1, 1964, issued by the Board of Supervisors to Standard Radio and Television Company, a corporatio~, and duly transferred to State TV Cable, a corporation, for the conduct, operation and maintenance of a community antenna cable television system within Butte County, be and hereby is amended to read as fo~lows: "1, A11 of the conditions set forth in the Code of ~he City of Chico, California, 1958 Edition, as amended in Sections l0A.13, l0A.I5, l0A.18, 10A.19, 10A.20, 10A.21, 10A.22, 10A.23, 10A.2~, 10A.25, 10A.26, 10A.27, ~OA.28, 10A.29, 10A.30, 10A.31, including a~l amendments there- to adopted by Section 1 of Chico City Ordinance No. 778, Section 1 of Chico City Ordinance No. 800 and Sections 1, 2 and 3 of Chico City Ordinance No. 9~9, together with Sections 3, 5, 6 and 9 0~ Chica City Ordinance No. 794 • as amended by Chico Ci~y Ordinance No. 820 adopted October 19, 1964, Chico City Ordinance No. 842 adopted November 1, 196b, Chico City Ordinance No. 851 adopted Ntay 16, 1967 and Chico City ~rdinance No. 881 adopted June 19, 1968; provided, that wherever in said Chico City Coae sections and : Chico City Ordinance sec~ions the words 'City o£ Chico' sha~1 occur, the words 'County of But~e' shall be substituted, and wherever the word 'Franchise' occurs, the word 'Lieense' sha11 be substituted,and wherever the word 'City' occurs, the word 'County' shall be substituted; and provided further, that on substitution of such words as aforesaid, said City Code and Ordinance sect~ons are incorporated herein by reference as conditions of this license." 2. _ _ __ __ _....: __ ., . - ~ 2. ~hat said Business Zicense be and hereby is further amended by adding thereto a new parag~aph to read as follows: "Grantee agrees to provide se~vice to a11 residential areas of the City of Chico by in- . stalling appropriate coaxial cables to each block wherein dwelling units a~e located." "Residential as herein used shall include all dwell~ng structures from single-family dwelling u~its up to a maximum of eight (8) dwelling units in any one building where billing is made to individual occupants. While the grantee is not required to install servzce to bars, restaurants and individual private of~ices and similar occupancies, if it does provide such service to such estab- lishments, the ra~es to be charged therefor sha11 be the same as herein provided to be charged to residential units upon single billings to each separate establishment."' "CommerciaZ~as herein used shall.mean aIl establishments or subscriber classifications not included under the above residential classification." "Grantee shail. also provide service free of charge for one outlet to each of the following, provided they are adjacent to their ins~alled cable system lines: Each parochial schoo~. Each public school Each City-opersted fire s~.ation 3. City police station Each recognized church recreation room."
