WHEREAS~ Assemblp Bill 2024 would require this Board to publicly invite
competitive bidding on all non~highway public works projects in excess o£
$3,500.00; and
WHEREAS, said znvitation would involve delays in time and expen.ses o£ ~
publicatians to the ultimate detri.ment of the taxpayex; and
W4iEREAS, said 6a.ssemb7.y Bil.J. 2024 wouJ.d decrease the xange of projects
for which tttis Board could 3.egally utilize ~'orce Account Labox; and
WHEREAS, S.t has been the expexience of this Boaxd tha~ true competitive
bidda.ng is always dif~9.cult and oftez~ itnpossible to obtain with regard to
pxo~ects costing fax in excess of said $3a500.00; and
WfiEREAS, Butte County has experienced receiving only one bid for
projects in excess of $100~000.OQ; and
WHEREAS~ this Board feels that the extension of the requirement of com-
petitive bidding as embodied in Assembly Bill 2024 will definitely operate to
~ the detriment of the local taxpayers by requiring nnnecessary outlays of
public monies for 1ega1 notices and publications;
NOW~ TfIEREFORE, BE xT RESOLVED that this Board is opposed to Assembly
Si11 2024~ and particularly Article 9 thereof insofar as said Bi11 exCends
the requirement of competitive bidding to projects which may currenCly be
conducted using Force Account Labor.
BE IT FURTfiER RESOLVBD that copies o~ this resolution be forwarded to
the Honorable Assemblyman Ray Johnson, the Honorable Senator Fred Marler and
the following memhers of ehe Assembl~ Local Government Committee: Honorable
Assemblymen Knox, Hom, Severlq, Brathwaite, MacDonald, MacGilivary, McCarthy,
Miller and Vasconce3.los.
