HomeMy WebLinkAbout7011 2~ 3 5 6 7 S 9 10 11 12 I3 14 15 16' 17 18 19 20 2I 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 0~ AN ORDINANCE PROVIDING FOR THE CARE,_ SALE., OR DISPOSITION; OF UNCLAIMED PROPERTY IN POSSESSION OF THE SHERIFF OF THE COUNTY OF BUTTE. The Board of Supervisors of the County of Butte do ordain as follows: SECTION 1: A11 unclaimed property in the possession of the Sheriff of the.County of Butte shall be by him held for a period of at least six months. SECTION 2: All unclaimed property in possession of the Sheriff of the County of Butte at the expiration of six months or thereafter, may be sold at public auction to the highest bidder for cash, and notice of the time and place of such sale shall be given by the Sheriff of the County of Butte at least five days 'before the time fixed therefor, by publication once in a newspaper of general circulation published in the County of Butte. SECTION 3: In the event of any such sale of unclaimed property pursuant to Section 2 of this ordinance for which no bids are received, the Sheriff of the County of Butte may, in his discretion, destroy or retain such property and offer it for sale at a subsequent time, or he may dispose of such property to any fraternal, civic, religious, or charitable organization or group. SECTION 4: All proceeds and receipts from any such sale or sales received by the Sheriff of the County of Butte shall' forthwith be deposited in the County Treasury of the County of Butte. SECTION 5: The Sheriff of the County of Butte shall keep and maintain an accurate record of the disposition. of all unclaimed property disposed of pursuant to the terms of this ordinance. SECTION 6: This ordinance is enacted pursuant to the provisions of Section 1873 of the Civil~Code of the State of California and any amendments thereof. SECTION 7: This ordinance shall take effect thirty (30} days after its passage and before the expiration of fifteen (15} days after its passage it shall be published with the names of the members voting for and against it at least once in a local newspaper published in the County of Butte, State of California.
