over the lands described ~n the Quitclaim Deed which is attacned
here~.o as Exhibit "A" and incorporated. herein as if set forth in

WHEREAS, th.e County received said land by deed dated
.Tuly 17, 1930, recorded in Volume 217, Page 427 of Deeds of Butte
County, California, which deed, alth.ough appearing to be a fee
conveyance, contained the following reservation:
~'Also-.reserving unto the grantors, their successors and
assigns, the right to use and permit the use of such
].ands in any manner that is not inconsistent with its
use for highway purposes."
W~i~RFu9S~ the only interest the County of Butte has in
said Iands is far said road purposes,
WHEREAS, the Lake Madrone Dam is included within the real
property described in ~hibit "A",
WHEREAS, the S~ate of California maintains th:at ir.i.fact
the County of Butte owns the Lake Madrone Dam and is ~esponsibl.e
for the maintenance as well as being responsib]~e for expansive
alterations so that the dam wil~. camply with state regulations
pertaining to dams,
WH~REAS, Lake Madrone is a private lake and this Board
finds that ~.t should not expend public funds for private benefit.
NOW, THEREFORE, BE IT RESOLVED:
That this Board au.thorizes the execution of the attached
Quitclaim Deed and authorizes the signature of the Chairman
thereon.
