CALIEORIQIA BE IT RESOLVI~D by ~he Board of Supervisors of the Caun~y of Butte, State of California, that it is th~ intention of said Bpaxd of , Supervisors to order the following improvements and acquisitions to be made in Parada.se Pines Assessment District No. 1, Units 1 and 2, Butte Coun.ty, Cali~orniz, to ~oit: ~he cons~raction of streets, roadside and outfall drainage ditches,.ancl drainag~ pipes, tog~ther with all.necessary inlef.s~, manholes, barricades and a7.1 other appurtenances necessary for a coinplete scheme o~ public improvements in ParadS.se Pines Units 1 and 2. The ins~al.lation of .a storm drain ditch and pipe from the east side o¢ Plorthwaod Drive near Rose- wood Dri.ve, for a distance of 330 fee~ to the East. Ins~allation of a storm drain ditch from the easti line of Lot .111 of Paradise Pines Unit ~70. 1, northeasterly foz a distance of 150 feet; Together with the acquisition of certain cl.earing and grubbzng performed in street right of way. BE IT RESO~VED that said improvements to be cons~ructied in the streets, avenues, lanes, courts, roads, places and/or public ways hereinabove 8escribed, will be of di.mensions, materials, and in the garticular l~cations, as set forth and shown on the plans and specificaf.ions and detailed dra~aings hereinafter referred to; to.ge:h~r with .~he construction of all appurtenances thereto, incl.ud- i.ng:n~cess.ary .fittings, tr~nchinc~s, grading and regradinq, excavation and fill, removal of obstructions, connect;ons to existing services, back fi11'ing, reconstruction of existinc~ ground surface as required tio conditions exis~ing prior ~.o commencement of cons'~ruction, aIl in the mann~r, of the ma~er.ials, and to the dimensions and ~o the grades, and in the pa~ticulaz l.ocatio.ns as tha same caill be more fu11y shown "~`.~ ;, `~ ~ ~~ r' ~ ~} ~ ` '1 ~ Y~ ~ ,: ~;~ ~~~~~~ ~~'~ to; That the structures and work and improve~~nts hcrein described shali be constructed to the grades, sub~grades and e~evatzons severally to be shown upon the plans and profiles and detailed drawzngs thereof in the respectiv~ locations ther~of, which said grades are hereby adopted as the official grades therefor for a11 purposes in connection with the groceedings pursuant to this Resolution of Intention. Notice is hereby givcn that said gra~es may be new and different from those hereto- fore established or existing, or may be difterent from existing ground levels. All of said work shall include, without dup~ication, any and all street intiersea~ions, termina~ions and opposite terminations occurrinq wi~hin the limitations of said work. The attention of al~ pezsons is directed to the fact ~hat not al~ of said classes of work above described may be constructed upon all the streets and/or public ways above described in their entirety, but only upon the particular ~acations as shosvn on the plans and specifica- tzons he~ea~ter referred to, which said plans and specifications shall gavern as to all details wzth re~atzon to the same, SE IT FURTFIER RESOLVED tha~ the Board of Supervisors of the County of Butte h~reby makes the expenses and costs o£ said improvements and acquisitions chargeable upon a dis~rict, which said district said Board hereby declares the district benefited by the improvements and ac- quisi.txons herein described; sa~d district shall ~nclude that terri- . tor~ in the County o£ Butte, State of Galzfo~nza, which is shown on that certazn map on fi~e ~n the off~ce of the County Clerk of the County of Butte, and which is entitled and described "Proposed Boundaries of Paradise Pines Assessment District No. I, Units 1 and 2, Butte County, California," and which said map indicates by a boundary line the exteat of the terri~ory included in the proposed district and covers all details as to fihe extent of the area to be assassed; said map is, by this refer- ence, incorporated herein and made a part hereof. • _2_ ~ .. . ~ ~ ~ _:.._.._ Excepting from the area shown and delineated on said map hereinabove referred ta, the area af all gublic streets, avenu~s, lanes, roads, drives, courts, pl~ces, pub~.ic parks, and all easements and rights-of--way therein contain~d belonging to the public, and also all. property o~raed by the County of Bu~te, the S~ate of California, or the United StatES of America, contain~d therein, now in use in the performance of a public function. NOTICE IS H~REBY G3VEN that serial bonds to repres~nt unPaid assessments, and bearing interest at the rate of seven per cent (7%) per annum shall be issued in the manner and form provided in Part S, Division 7 of the Streets and Highways Code of the State of California (Improvement Act of 1911) to represent unpaid assessments of Fifty Dollars ($50.00} or over, the last installment of whS.ch bonds sha~i ma~ure fourteen (1~1) years from th~ 2nd day of January next succeeding the next September ].st following ~heir date. Said bonds shall be payabl~ to bearPr, and may be redeemed as provided in the Improvement Ac~ of 1911, and there shal]. be added to ~he redemption clause in said bonc~s the foliowing words: "....together with a premium of five per cent (5~) of the unmatured principal." In case of default, theze sha11. be added to the defaulted amount one per cent (l~) of the amount thereof, and on the lst day of each month foll4wir~g s~ch de£ault there shall be added a further penalty af one per cent {1~) o€ such defaulted amount. The one per cent (1$) penalty firs~ imposed shall be retained by ~he Treasurer as a cost of servicing the delinquency and a~.l subsequent penalties sha11 be paid to the ha.ld~r of the bond along with and as a part of such defaulted payment. Proceedings for a11. work shall be taken pursuant to the Muni- cipal Impr.ovement Ac~t of 19~.3, and the bonds hereinabove described sha11 be issued under the provisions of the Improvement Act of 1911 as heretofore described. - -3- of Sections 10203 and 10204 of the Streets and Highways Code, being a part of the tdunicipal Im~rovement Ac~ of i913, the matter of the improvements and acquisitions herein referre~ ~o is hereby refezred ~o ~he birector of Public 44orks of the County of Butte, as Engineer of LVork of said Assessment p~strict, and the person having charge and con~rol of the improvemen~s and acquisitinns described in this reso- lution. Said Engineer of L•7ork zs hereby dir~cted to make and file with the County Clerk of the County of 5utte a report in writing contain- ing ~he follo~aing: a. Plans and spe~ifications of the praposed improve- men~ if th~ improvemen~ i5 not al~eady installed; h. A g~neral description of the works or appliances already instaTled and any other property necessary or conveni~nt for the op~ration of the improvement, if the works, appliances or pr.oper~y are to be. acquired as part of the improvement; c. An estimate of the cost af the improvement and of the cost of lands, rights-of-way, easements and incidental expenses in connection with the improve- menti. If the legislative body in the resolu~~on of intention ordered that private utilzty damages be included in the assessment, the report shall contain an estimate of private utility damages; , d. A diagram shocaing the assess~ent district and the boundaries and dimensions of the subdivisions of land within tihe district as they existed at the time of the passaqe of the resolution of intention. Each subdivision, including each sepa~ate condomin- ium interest as defined in Section 783 0~ the Civil Code, sha1Z be given a separate number upon the diagram. e. A praposed assessment of the total amoun~ of the cost and expenses of the proposed improvement upoxt the 5evexal subdivisions of land in the district in proportzon to the estinated benefi~s to be received by sucn subdivisions, zespectively,, £rom the:improvement. ~~Then any portion dr percent- age of the cost and expenses of the improvement is order~d to be paid out o~ the ~reasury of the municipalzty, pursuant to Sectzon 10200, the amount ot such portion or percentage shall first be a~au~t~a tro~ the tota~ estzmated cost and expenses ot the improvement, and the assessment upon prop~rty proposed in the r~port shall include only the remainder of the estimated cost and expenses. The assessment st~all refer to the sub- divisions by their respective numbers as assigned pursuant to subdivision {d) of this section, -4- BE iT FURT:i~R R~SOLVED that if any surplus remains in the Improvere~ent Pund after the cnmpletion o£ the improvements and ~he payment of all c~aims from the Improvemen~ Fund, said surnlus shall be dis- txibuted in accordance with Section 10427 of the Streets and I~tighways Cade.
