HomeMy WebLinkAbout70-120~ 2 3 4 5 6 7 $ 9 10 1Z 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 3 7, 32 ~i RESOLIITION N0. 70-120 BOARD OF SUPERVISOR3 COUNTY OF BUTTE, STATE OF CALZ~ORNTA ResoluCion Establishing Oroville Dam Boulevard Underground UCility District No. 1 BE IT RESOLVEll by the Board of Supervisors of the County of Butte as follows: WTiEREAS, by resolution dated 3une 30, 1970, a pubiic hearing was called for on July 28, T970, at the hour of 11:00 A.M. zn the Board of Supervisors Room ia the Courthouse, Oroville, Ca1i£oxnia, to ascertain whether the pubLic necessity, health~ safety or weZ~are ~equixes the removal of poles, overhead wires and associated overhead stxuctuzes, and the underground installatiion of wires and facilities for supp~ying electric, communication or similar or assoc~ated sexv~ce, within that certain area of the county described as foilows: Be~ng a portion of Sections I7~ I8 and 19~ T19N, R4E, MDB&M, more particularly described as follows: Beginning at the southwest corner of "Seem Tndustrial Tract", which map was filed for record on February 10, 1950, in Book 17 at pages 33 and 34~ But~e County0fficiaZ Records; thence westerly along the sou~h line and the westerly prolongation thereof of Butte County Assessor's P~ cel ~~35-03-34 ~o the westi line of Oroville-Marysville Highway; ~hence nor~herly along t~e said west line of Orov~lle- Marysville Highway tio ~he souCheasti corner of Assessor's Parcel ' ~~35-03-35; thence westerly along the south line and northerly along I ehe wese line and easterly along the north line of said Assessor's I, parcel ~k35-03-35 to the southerly prolongation of the westerly line of Assessor's Parcel ~k35-03-03; thence northerly along the said westerly line of Assessor's Parcel ~k35-03-03 and the westerly line of Assessor's Parcel ~k35-03-02; thence easterly along the northerly line and the easterly prolongation thereof of Assessor's Parcel 4k35-03-02 eo ~he easterlp line of Feather River Boulevard; thence northerly along the easterly line of ~eather River Boulevard to the northwest corner of said "Seem Industrial Tract"; thence easterly along the north line of "Seem Industrial Tract" to the most westerZy corner of Assessar's Parcel ~k35-26-46; thence northeasterly along the northwesterly Line of said Assessor's Parcels dk35-26-46 and 4~35-26-59 Co the westerly pro~ongation of the north line of Assessor's Parcel ~~35-26°45; thence easterly to the northeast carner o£ sa~d Assessor's Parcel ~k35-26-45; thence northeasterly in a straight line to the intersection of the westerly prolongation of the south line of Assessor`s Parcel ~k35-27-07 with the southeasterly right of way line of Veatch Street; thence easterly to t~e southeast corner o£ said Assessor's Parcel ~k35-27-07; thence southeasterly along the easterly line and the southeasterly prolongation thereof of Assessor!s Parcel ~k35-27-OS to ehe south line of Oroville Dam BouZevard; thence southwesterly along the south line of OrovilZe Bam Boulevard to the easterly line of tihe 60 faot right of way within Assessor's Parcel ~~35-27-05; thence south along a line parallel with and distant easterly 140 feet measured perpendicular to the west line of Assessor's Parcel ~k35-27-05 to the easterly prolongativn of the south line of Assessor's Parcel ~k35-26-63; thence southwesterly along the south line of the follawiag Assessor's Parcels #35-26-63, 4~35-26-11, ~~35-26-10, ~~35-26-9, ~~35-26~8, ~k35°26-6$', #35-26-40, ~~35-26-26~ ~~35-26-55 and ~~35-2b-58 to the nortkteast coxner of Assessor' Parce1 ~~35-03~25; thence south along the east li.ne of Assessor`s Parcel ~~35-03-25 to the southeast corner thereo~; thence westexly along the south line of 35-03~25 and the south line o~ "Seem Tndustrial Tract" to the PQTN~ OE BEGINNING. ~ 2 3 4 6 6 7 $ 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2~ 23 28 ' 2'7 28 29 30 31 32 ~ WHEREAS, notice of such hearing has been given to a11 affected praperty owners as such are shown on the last equalized assessment roll and to a11 uti~~ties concexned in the manner and within the Cime required by law; and W1~EREAS~ such hearing has been duly and regularly held, and all persons interested have been given an opporCuni~y to be heard, NOW~ THEREFORE~ BE IT RESO~VED by the Board of Sapervisors af the County of Butte, that, pursuant to Ordinance No, 981 of the County of Butte, the above-described area is herebq declared an Underground Utility District, and is designaeed as Oroville Dam Boulevard Underground Utility District No. Z of the County of Butte. Attached hereto and hereby incorporated as a part of this resolution is a map delineating the boundaries of said District; RESOI,VEDx EUR~Ii~R, THAT Tii~ BOARD OF STJPERVTSORS does hereby £ix .Tul.y J., J.971, as the date on which a~Eected propexty owners must be ready to xecei.ve underground service and does hereby order the removal of all poles~ overhead wires and associated overhead structures and the underground insCal- lation of wires and facilities for supplying elec~ric~ communication~ or similar or associated service within Oroville Daca Boulevard Underground Utility Bistrict No. 1 on or before September L~ 1971, RESOLVED, FURTHER, that ~Che CounCy Clerk is hereby instructed to noti£y aII affected utilities and a11 persons owning real property within Oroville Dam Boulevazd Underground Utility District No. 1 of Che adoption of this zesolution within ten (10) days after the date of such adoption. Said County Clerk sE~all £urther notify said property owners of ~he necessity that, if they or any pe~son occupying such property desire to continue Co receive el.ectric, commuztication, ox other similar or associated service, ~.hey or such occupant sha1.7., by the date fixed in this reso3.ufion~ provide a11 necessary facility changes on their premises so as to receive such services from ~.he lines of the supplying utility or utilities at a new location~ subject to applicable rules~ regulations, and tari£fs of the respective v.tility or utilities on file with the Public Utilities Commission of the State of California.
