AUTHORZZI~IG EXECUTION OF AGREEb4ENT
BE IT RESO~,VE1? by the Board of Supervisors of the
Courity of Butte, State of California, that AlURRAY ~, A4CCORMICK, INC.,
be and they are hereby appointed as Projec~:-£ngin:eeX for the doing
of all necessary engineexing work and exercising all of the engineer-
inp functions grovided for under the provisions of the D4unicipal
Improvement Act of 1913 in connection with the improvements and
acquisitioris ta be ~ade in proposed Paradise Pines Unit No. 3 Assess-
ment District, Butte County, California; and
BE IT FURTHER RESOLVED that the employment o£ the said

and
BE IT FURTf-iER I2ESOLVED that the Chaixman of the Board ~f
Supervisors be authorized to sign, and the County Clerk thereof be
authorized to attest, that certain agreement employing the said

A G R E E M E N T
THIS AGREEA4ENT, made and enterec~ into this llth day of
August, i970, by and between the COUtVTY OF BUTTE, a political sub-
division of the State of California, hereinafter called First Party,
and A4URRAY F, MCC~IL~ITCK, INC., a California corporation, hereinafter
called Second Party;
W I T N E S S E T H:
That for and in consideration of the mutual covenants
and agreements herein contained, the parties hereto~agxee as fo3.lows:
1. First Party proposes to initiate special assessment
proceedings for the impravements and acquisitzons to be made in
Paradise Pines Unit No. 3 Assessment District, Butte County, California.
2. Fi.rst Party employs Second Party as Project Engineer
for the doing of all necessary work and exercising a11 engineering
functions provided for by the provisions of tlie Dlunicipal Improve-
ment Act of 1913 in connection with the said improvements and acquisi-
tions to be made in said district. Said services shall include the
follawing:
- a. Doing of all necessary engineering work and ~
exercising of a11 engine~ring functions pro-
~ vided for under the pravisions of the r4uni-
'~".' cipal Improvement Act of 1913;
b. Preparation and furnishing of all surveys,
original drawings, maps and bluepxints, p~.ans
and specifications, preparation of assessment
roll, assessment diagram, and any and all
•'~ other services which may be reauired under
the provisions of Lhe said r'Iunicipal Imgrove-
~° ° • ~- ment Act of 1913;
'°` c. Supervision and direction of all engineering
work reQuired to be taken by First Party or , _

ne~tion with said ir~provements. Said duties •

of all property o~aners within the bound-
ara.es of the district as sho~an on the last
equali~ed ro11 for taxes or as kno~an to
the &ngineer. Said Iist sha11 include
coordination of the name and address with
the assessment and diagram number, and the
groper description o€ the property or Lhe
County Assessor's parcel number of each lot,
pieee, or paxcel of land shown on the assess-
ment diagram, when appropriate. ~
d. Rendition of general consultation and advice
to First Party, its officers, agents, or
employees with respect to the planning, gre-
• paration and handling o£ a11 engineering phases
of the aforesaid proceedings;
~. Attendance at such conf~rences and public
sneetings with First Party as may be reasonably
necessary to perfoxm this contract of employment.
3. Second Party shall recei~e compensation ftor the above
services as follows: ~
The sum of $46,800.00.
The above amount shall be paid by First Party out of the
proceeds of assessments levied and bonds to be issued in said praceedings.
4, In ~he event said proceedings are not carried through
to con~l.usion, or shall be abandoned, then SeCOnd Party shall receive
nothing.
IN WITNESS WHEREOF, the parties have hereunto subscribed
their names, First Party by its Chairman of the Board of Supervisors, ,
attested by its County Clerk, the day and year in this agreement
