' . . .. .. ~i ~ ~ 7~~ RESOLUTION rro. i~~ RESOLL-TION AiVD ORDER PRELI~IINARILY ADpPTIi~G ENGINEER`S RF.PORT, SETTING PUBLIC HEARIIvG AvD CflI,I,ING FOR BIDS, • PARADISE PINES UNIT N0. 3 ASSESSDI~NT BISTRICT, BUTTE COUNTY, CALIFORNiA WHEREAS, on the 11th day of August, 147fl, the Board of Supervisors of the County of Butte, State of Cali.fornia, adopted ~ its Resolution of Intention for the improvements and acquisitions to he made in Paradise Pines Unit No. 3 Assessment District, Butte County, California, and referred said improvements and acquisitions Lo the Engineer of R'ork for said assessment district; and ~ WHEREAS, said Board of Supervisors directed that said Engineer of 14ork make and file with the County Clerk of the County of Butte a report in writing in accordance with the provisions and -requirements of the A4unicipai Improvement Act of 1913 of the State of California;, and ~ WHER~S, said Engineer of ~York did, on the ].~.th day of August, 1970, fa.le with the County Cl.erk of the County of Butte a report in accordance with the said resalution, and said County Clerk has presented the report to this Board of Supervisors for cansider- dtion; NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, and this Board hereby finds: I.' That the report made ancl fi2ed by the Engineer of Work on the llth day of August, 1970, contains a1Z of the require- ments provided for said report hy the provisions of the hfunicipal Improvement Act of 19i3, including (1} specifications; (2) platts and profiles and estimates of cost; (3) assessment diagram and assess- ment; (4) descriptions of easements and/ox rights-of-way to be aCquired. . , • -1- , ~ .. . ~.~~~~~~~~~~ 2. That said report, and each and every part thereof, is sufficient in every particular, and it is hereby determine~ that said report shall stand as the repoxt for all subsequent proceed- ings under said ~iunicipal Improvement Act of 1~13; and BE TT FURTEiER R~SOLV~D that Tuesday, the 22nd day of September, 1970, at the hour of 11:00 oTclock A.~4..of said day, at the meeting place of thc Board of Supervisors of the County o~ Butte, located in the Butte County Courthouse, Oroville, Cali£ornia, is hereby fixed as.the time and place for hearing protests 3aith rela- tion to the proposed imprnvements and acquisitions described in said report; that any person interested in objecting to said im~rovements and acquisitions, the grades to which the work will be done, or has been done, the extent of the assessment district, the assessment, or the engineer's estimate o£ cost and expenses, or any other act or determination of the Board of Supervisors or the Engineer of tYork of the assessment district may file protest in writing with the County Clerk of the County of Butte a~ or before the hour fixe~ herein for hearing thereon; and BE IT FURTHER R~SO~VED that the Caunty Clerk of the County of Butte be, and he is hereby, directed to gublish a Notice of Im- provement pursuant to Section 6066 of the Government Code of the State of California, the first of which said notices to be first publzshed at least twenty (20) days prior to the date herein set far hearing of protests; and BE IT FURT~iER RESOLVED that the County Clerk of the County of:But~e be, and he is hereby, further directed to cause Notices of Improvement to be posted on all of the open streets within the ----d-istrict described in the Resolution of Intentian at not moxe than three hundred feet apart on each street so posted in accordance with the requirements of Sections ~0302 and 10303 of the Municipa2 Im- provement Act of i913; and -2- . B& IT FURTijER RESOLVED that notices of the adoption of the Resolution of Intention and filing of the Enginaer's Report shall be mailed, postaoe pxepaid, to all persons o~aning real property to be assessed -ahose names and addresses appear upon the last equal- ~ ized assessment roll for taxes, or are knawn to the County Clerk. Said notices shall cvntain the matters required::in Section 10307 of the ~lunicipal Improvement Act o£ 1913 of the State of Cali£vrn~a. BE IT F~RTHER RESOLVED that this Board of Supervisors hereby preliminarily orders that the improvements and acquisitions describ~d in the Resolution of Intention be had and done in accord- ance with the plans and specifications and profiles for said work. The plans and specifications with said report axe hereby adopted as the plans, profiles and speci~icatinns for the doing of said work and improvements, and said Board of Supervisoxs hereby orders that bids shall be received for the doing of said work and improvements pn the ~th day of 5eptember,.1970, at I1:00 o'ciock A.~i, of said day. Said bids or proposals shall be delivered on or before 11:00 o'c1oCk A.A4. of the $th day of Septemher, 1970, to the Board o~ Supervisors of the Gounty of Butte, in the Chambers of said Board, located in the Courthouse, Butte Caunty, Oroville, California, which said time and place are hereby £ixed as tne time and place of a public meeting at which said bids will be publicly opened, examined and declared by the County Clerk of the County of Butte.
