The acquisition of all necessary rightcs-of-way
to accomplish the foregoinq, for a comglete
scheme of i.mprovements in Paradis~ Pines Uni~s
No. 5 and 6 Assessment Distrzct.
BE 3T RF:SOLVED ~hat said improvements to be constructec3
in ~he streets, avenues, lanes, courts, roads, ~laces and/nr public
ways herei.nabpve deseribed, will be of dimensions, materials,
and in the pazticular locations, as set fdrth and shown on the

plans and speci~ications and detailed drawzngs h~re~nafter refer-
red to; together c~ith the construc~ion ot all appur~enances thereto,
inciuding necessary fit~ings, ~renchings, grading and regrad~ng,
excavation and ~ill, ren~oval of obst~uc~ions, connections ~o exis~°
ing services, back filling, reconstruction of exis~ing ground
surface as required to condi~ions exis~ing prior tn comm~ncement
of constxuction, all in the manner, of ~he materials, and to the
dimensions and to ~he grad~s, and in the par~zcular loca~ions
as ~he same wi?.l be moxe fully shown on the plans and specifi-
oa~ions and detailed drawzngs hereinafter referred to;
That the s~ruatures and work and improvenents herein
described shzll be cons~ructed to ~he grades, sub-grades and eZeva-
tions severally to be shown upon the plans and profiles and de~ailed
drawings thereof in the respec~zve ~ocations thereog, which said
grades are hereby adop~ed as the official grades therefor for
al~ purposes in connection wi~h the pxoceedings gursuant to this
Resolu~ion of Intention. No~ice zs hereby given ~ha~ said grades
may be new and different from those here~ofoze es~ablis~ed or
existing, or may be different £rom exis~ing gzound levels.
A11 of said work shall include, without duplicatinn,
any and all street xntersections, ~erminations and opposi~e termina-
tions occurring within the limi~ations of said work.
The attentzon of all persons is directed to ~he fact
~hat not a11 0~ s~id classes of work above described may be cons~ructed
upon all the streets and/or publ~c ways above described in their.
entirety, but only upon the particular locations as shown on the
plans and sgecifications hereafter referred to, which said plans
and speci£ications sha11 govern as to all details with relation
to the same.
BE IT FURTFiER RESOLVEU that the Soard of Supervisors
of the County of Butte hexeby makes the expenses and cos~s of
said improvem~n~s an~ acquisitions chargeab~e upon a dis~rict,
which said dis~rict said Boaxd hereby declares the district bene-
fited by ~he improventen~s and acquisi~ions herein deseribed; said
distzict shall incl~de ~ha~ ~erri~ory in the Coun~y of Bu~~e,
State af California, which is shown on tha~ certain map on £ile
zn the nffice of the County Clerk of ~he County of But~e, and
which is en~itled and d~scribed "Proposed Boundaries of Paradise
Pxnes Uriits ~o, S and 6 Assessment District, Caunty of Butte, 5~atie
of Cali~o~nia," and urhzch said map indica~es by a boundary line
the extent~of the terzi~ory anc~uded in the proposed district
and covers all details as.to the ex~en~ of the area ~o be assessed;
said map is, by this reference, incorporated herain and made a
part hereof.
Excepting from ~he area shown and de~ineated on said
map hereinabove referred to, the area of a11 pub~ic streets, avenues,
lanes, roads, drives, cou~ts, places, pubZic parks, and ali ease~en~s
and rights-of-way therein contained belonging to the ~ublic, and
also all property owne~ by the County af Bu~~e, .the Sta~e of Cali-

fornia, or the United States of America, contained therein, no~a

in use in the performance of a public func~'zon.
NOTICE IS HEREBY GIVF'N that serial bonds ~o repr~sent
unpaid'assessments, and bear~ng intezes~ at the rate o~ seven
per cent (70~ per annum shall be issued in the manner and form
provided in Part 5, Division 7 ot the Streets and Highways Code
of ~he 8~ata of California (Improvem~nt Act of 1911} to repre-
sent unpaid assessinents of Fifty Dollars ($50.00) or over, ~he
last installm~nt of which bonds shall mature fourteen (14) years
from the 2nd day of January next succeeding the nex~ Septiember
lst following their date. Said bonds shall be payable to bearer,
and may be redeemed as provided in ~he Improvemen~ Act of 1911,

and ~here shall ~e added ~o th~ redemp~ion clause in said bonds
the fallowing words:.
" ..together wi~h a premium of five per cen~ {5$) of
the~unrnatured principal."
In case of default, ~here shall be added to t~ie defat~.lted
aFnount one per cent (l~} of the amoun~ thereof, and on tche ls~ c3ay
of each moni:h fo~lowing such default ther~ shaX~ be added a~urther
penalty of one per cent (lo) of such defaulc.ed a~ount. 'I'he one per
cent (1~) penalf.y first imposed shall be retained by the Treasur~x
as a cost of servicfng the d~linquency and a11 subsequent penal~ies
shal}. be paid to the holder of the bond along with and as a part
of such defaulted payment.

visions of Sec~ions 10203 and 10204 of the S~reets and Highways
Code, being a part of the A2unicipal Improvement Act of 1913; ~he
matter of the improvements and acquisitions herein referred to
is hereby referred ~o th~ Direc~or o~ Public ~Jorks o~ ~he County
of Bu~te, as Enga.neer of work of sazd Assassmen~ Dzs~rict~ and
the person having charge and control of ~kae improvemen~s and acqui~-
si.~ions described in this resalution. Said person is hereby directed
to make and file.with the Cnunty C3.erk of the Coun~y o~ But~.e a
report i.n wri~ing containing the follo:aing:
a. Plans and specifications of the proposed improve-
m~nt if the improvement is n~t already installed;
b, . A general descrip~ion o~ the worY.s or appZiances.
~ already installed and any other property necessary
or convenient for the operation o£ the improvement,
if the works, appliances or property are to be

acquired as part of thE improvement;
c. An estimate of the cost of the imp~ovement and o~
the cos~ of lands, rights-of-way, easements and
incid~ntal expenses in connection wi~h the improve-
ment. If the legisla~ive body in the reso3u~ion
of int~ntion ordered tha~ private utility damaqes
be included in the assessment, ~he report sha~l
con~ain an estirnate o~ priva~e utili~y damages;-'
d. A diagxam showing the assessment dis~rict an~ the
boundaries and dirnensions of the subdivisions o~
land c~ifihin the dis~ric~ as ~hey exis~e8 at the
tfine of ~he passage of ~h~ resolution of in~ention.
Each subdivision, including each separate condomin-
ium interest as defined in Section 7B3 of the
Civil Code, sh'alI be given a separa~e numbex upon
the diagram.
e. A proposed assessment of the total amount of the
cas~ and.expenses of the proposed improvement
upon the several subdivxsions af land in th~
distric~ in proportion to the estirnated benefi~s ~
to Ua reoeived by such subdivisions, resp~c~ively,
~rom the im~~ovement. when any partion or percen~~
age o~ the cost and expenses of the improvement
is ordered to be paid out o~ the t~easury of the
municipali~y, pursuant ~0 5ection 102QO,.the
amount of such portion or perc~ntage shall first
be deduc~ed fxom th~ to~a1 estimated cost and
expenses of the improvement, and the assessment
upon proper~y proposed in the report shall includ~
only the remainder of ~he estima~ed cost and
expenses. The assessmen~ shall refeY to th~ s~lb-
divisions by their respective numbers as assigned
pursuant ~o subdivision (d] of this section.
~,BE IT FURTH~R RE50LVED that if any surplus remains in
the Improtrement Fund after the compZetion of the impravements
and the p~ymznt of all claims from the Improvement Fund, said `

surplus`shall be distribnted in accordana~ with Section 10427
of ~he Str~e~s and Highways Code.
BE TT ~URT~iER RESOLVEb that it is the intention of said
County of Butte to enter into an agreement with bel Oro Water
Company under the ~erms of which the Coun~y of Butte will eonvey
~o the De~ Oro Wate~ Company a system of water dis~ribution ~
faciiities in accordance with the provisions of Section 10109-
lOlll, inclusive, of the Streets and Highways Code of the State
of California. ~
