WHEREAS~ on ~he 20th day of October, 1970, ~he Board
of S~pervisors of the County of But~e, S~a~~ of California, adop~ed
i~s ~esolutzvn of Intentian ~or the improvements and acquzsi~ions
in Paradise P~nes Units No. 5 and 6 Assessmen~ nis~ric~, Coun~x of
Butte, State of Ca~ifornia, and referred said intpxovements and
acquisitions ta CLAY CASTLEII~RRY,Dxrec~or nf Public Works of
the Coun~y of Bu~te,as Engineer of WorY, fo~ said assessment dis~rict;
and
WHEREAS, said Baard of Superviso~s directed tha~ said
Director o~ Public Works as Engineer of work make and file with
the County C1erk of ~he County of Bu~t~ a repor~ in wri~ing in
accordance with the provisions and requirements of the Municipal
Improvement Act of 19Z3 of the State of Calif~rnia; and
W~IEk2EAS, said Direc~or of PubXic Works as Engineer of
Work did, on the 20th day of ~October, 1970, file with the Goun~y
Clerk of the County af Butte a repor~ in accordance with the said
resolution, and said County Clerk has pzesented the report to
this Board fax consideration;

visors of th~ County of But~e, S~a'ce o~ Californi.a, and this
Board hereby tinds:
1. ~ha~ the report mad~ and filed by the Direc~tor of
Public 6VOrks as the Engineer of A'ork on the 2~~~ day of Octouer,
1970, contains all of t.he requirements provided for said re~or~
~~.1~~~~~
by ~he provisions a~. the Aiuniczpal Smp~ovement Act of 1913, includ-
ing (1) speci~ications; {2) plans and profiles and.~stimates o~
cast; (3) assessment diagram and assessment; (4) d~scriptions
of easemen~s and/or rights-of-way fo be acquired.
2. Tha~ said repor~, and each and every part ~hereof,
is sufficient in every particu~ar, and it is hereby d~~ermined
tha~ said report shall s~ana as the repor~ for all subsequen~
proceedings undex said P4unicipal Improvement Ac~ oP 1R13; and

fornia, is hereby fixed as the time and place Eor he~ring pro-
tes~s with z~la~ion to the proposed improvements and acquisitions
describ~d in said report; that any person in~eres~~d in abjecL-
ing ~o said imgzovemen~s and acguisitions, the grades ~o which
the work ~vil1 be done, or has been done, ~he extent of the assess-
men~ dis~ric~, tihe ass~ssment, or the engineer's estimate of cast
and expenses, or any other act or determination of the Board•of
Supervisors or ~he Director of Public [4arks as the Engineer o~
Work of the assessment district may file protest in writing with
the County Cle~k of the County of Butte at or be~ore the hour
fixed herein far hea~ing thereon; and
BE IT FURTH~R RESOLVED that the County Cl~rk of the
County ot Butte be, and he is h~reby, directed to publish a Notice
of Improvement pursuan~ to S~c~ion 6066~of th~ Gavernment Code
of the State of California, the first of which said notices tfl
be tirst published at least twenty (20) days prior to the date
herein set for hearing of protests; ana
BS IT ~URTHER RESOLVED that the County C~ezk pf the County
of But~e be, and he is herebX, further ~irected to cause Notices

o~ ~mprovemen~ tq be posted on all of the open streets wzthin
the district desczibed in the Resolu~ion o~ In~en~ion at not more
than three hun~red feet apart on each s~reet so pos~ed in accord-
ance with the requirements of Sections 10302 and 10303 of the
Municipa~ Improvement ~ct of 1913; and
BE IT FURTHFR R~SOLV~D ~ha~ notices of ~he adoption ~
of the Resolutiion of Tnten~ion and filin~ of the Fngineer's Repor~
shall be mai~ed, postage prepaid, to all persons ownin~ real pzop-
erty ~o be assessed whose names and addresses appear upon the
last equalized assessmen~ rol~ for taxes, or are known ~o the Coun~y
Clerk. Said notices stzall contain the mat~ers regui-r~d in Section
10307 of the Municipa~ ~mprovement Ac~ of 1913 of the State of
California. _ ~ ,
BE IT FURTI3~R RESOLVED that this Board hereby prelamin-
ara.ly orders that the improvemen'ts and acquisi~ions described
in the Resoluta.on oi In~en~ion be had and done in accordance wa~h
the pians and specifications an8 profil~s £or said work. The
plans and specifica~ions wiich said report are hereby adnp~.ed as
the plans, profiles and speci£ica~.ions for the dozng of said work
and improvements, and said Board hezeby orders that bids shall
be received £or the doing of said wpzk and improvements on the
-10th day of November, ~.970, at ].1:00 o'clock A.P~t. of said day.
5aid bids or prp~osals shall be dela.vered on or before 11:00
o'clock A.M, of the 10~h ~a~, p€ Novembe~ 1970, at the office of ..
the County Clerk of the Coun~y of Butte, But~e Coun~y Courthouse;
Orpvxlle, Cali.~ornia, which said time and place are hereby fixed
as the time and place of a public maeting ati which said bids Friii

the County of Butte.

The Board of Supervisors reserves ~lie righ'~ to reject
any and a11 proposals or bids should it deezn this necessary for
th~ publi.c good, and alsa ~he bid of any bidde~ who has been de-
~.inquent or untaithful in any former con~ract wifi.h the Coun~y of
Bu~~e.
