Article 26 of the Consti~ution of ~Fie::State of California, which
sec'tion presently provides tha~ gasoline tax funds sha11 be used
excYusively tor the maintenance and construction of California
highways, county roads and city streets; and
WHEREAS, Proposition 18 proposes to grant to a local
agency the au.thority to divert a portion of~ its allocated
gasoline tax funds as well as funds allocated for state highway
construction and maintenance for such area for capital expenditures
to facilitate public transporta~:.ion, including mass transit syst~n~s;
that such proposition further directs the Legislature to enact
legislation whereby highway user tax ~unds shall be used for the
control of environmental pollution caused by motor veh.icles; and
WHEREAS, there exists an urgent need for the use of
gasoline tax funds for the maintenance and con"struction of highways
bec'ause of their growin.g deficiency and inadequacy both ~.ocal and
sta'te wide; and
WHEREAS, a diversion by a lo~al agency of such funds
for mass transi~ systems wiil foreseeably result in a deficiency
of moneys for highway maintenance and cons~truction in such local
area; that such a condition wi11 result in a compelling need by
the State Legislature to increase the ailocation to the area
diver~eing moneys for mass transit systems and reduce the allocation
to those areas such as Butte County which do not have a mass
transit system; and

WHEREAS, a gasoline tax revenue presently received by
But,te County pursuant to said Section 1 of Article XXVI is in-
adequate thereby necessitating the use of i~ lieu taxes and
motor vehicle registration fees to meet Butte County's needs for
h.ighway construction and maintenance; that any reduction of the
gasoline tax would require the use of other 1oca1 funds for high-
way purposes, which would ultima~ely result in an increase in
local property taxes; and
WHEREAS, moneys can now be appropriated by the ~egis-
lature for the control of environmental pollution caused by
motor vehicles from funde derived from motor vehicle registration
and weight fees withouti an amendment ~o the California Constitutio n;
and
WHERF,AS, the necessity for continued highway development
w~ii not be reduced either locally or state wide, regardless
of what may be done to implement a mass transit plan or air
pollution controJ. measures;
NOW, THEREFORE, BE IT RESOLVED that thi.s Board does
hereby oppose Proposa~tion 18 for the aforesaid reasons.
BE IT FURTHER RE50LVED that the electara~e be and
they are hereby urged ~o cast their vote against Proposition I8.
