WHEREAS, this Boa~d has received the Peti.tion of Mr. .7ohn
Drake requesting that the following described property be annexed
to County Service Area No. 23, and to allow drainage from the here-
in described property to fiow into County Service Area No. 23
drainage facilities:
"A partion of Lots 38 and 39, according to that certain
map entitled, "Hobart Subdivision of the baniel Bidwrell Rancho",
which Map was recorded in the office of ~.he Recorder of the
County of Butte, State of Cali~ornia, on November 7, 1904,
in Book 4 of Maps at page 24, and more particularly described
as follows:
Beginning at the most Northerl y corner of said Lot 38,
which point iies in the centerline of Lassen Avenue; ~hence
South 38° 04' East 417.23 feet along the Nortneasterly line
of said Lot 38 to a point on the Westerly line of that certain
parcel of land as described in that certain Deed executed by
Rachel Annett Reed, a widow to the City of Cnico, a m~ua.icipal
corporation, dated May 18, 1942 and recorded June 12, 1942,
in Volume 300 of Official Records of Butte County, at page
140; thence South 15° 52' West, 471.96 feet along said line ~
and its extension; thence North 38° 04' West, 695.08 feet to
a point on the Northwesterly line of said Lot 38 and the
cei~terline of said Lassen Avenue; thence North 51° 56'
East, 38~.50 feet along said Northwesterly line of Lot 38 and
said centerline of Lassen Avenue, to the point of beginning."
WHEi2EAS, said drainage facilities were originally con=
structed by assessment d~.strict proceedings,
WHEREAS, it is the intent of this Board to allow annexa-
tion provided that Mr. JoJ~x~ Drake pay into the sexvice area
maintenance fund an amoun~ equivalent to what his assessment would
have been had he originally been part of the assessment district.
NOW, THEREFORE, BE IT RESOLVED by this Board as foliows:
1. That the above-mentioned annexation be referred to
the Butte County Local Agency Formation Commission for their
comments, recocnmendations and approval.
