It is my esti~.atza~. ~hat the v.ictim, Betty Ann Scheu~rmann, died while attemp~ing to save three sma~.~. ch~ldr~n a.n the car. My a~ficiaZ r~port indica~~s, in par~: ' "She {Mr~. Scheuermann.) then got aut of the car, opened the rear door apparently ~gnora.ng the danger a~ th~ approaching trazn ~.n a~utile effort to remav~ ~he ~hree sma~l ch~.~dren fram the vehicle; when~~he train struck her and the car, knocka.ng it off, the eas~ side o.~ the tracks. ~. 3.'here a. s no doubt in my mind that she c ou]. d have saved her awn li~e by st~pping.back four or fa.ve paces as ~he hazard af the onru~hing train was apparen~ at the timc. After compT.etiag the accide~t ~.nves~a.gat~,on (Report No. 24'~-'1'I-'~4-6) on file at'~ ~he California Hzghway Patr~ol Office in Chico, California, it is my opinian that Mrs. Be~ty Ax~n Sch~uermann (d~cedent) driver o~ the vehic].e involved with the tra~n gave her 1.ife whi~e attempting to rescue three small childr~n ~rapped in her vehic~.e as a resul~ of th~ above accident. Th~ v~hicle she was drivin~ came to r~st on the Sou~hern Pac~.~ic Ra~.l.road tracks as a resul~ of the accident, while a~ the same t~me ~ an. approaching train pu~.~.ing 82 frei~ht cars was unable to ~stop a.n t~.me to avoid hi~~ing the above vehicle locat~d on th~ raa.lroad tracks. At thi~ ~ime, Mrs. B~t~y Ann Scheue~ann (~ubs~an~zatea by independen~ witnesses} was seen outside af the wrecked vehic~.e attemp~ing to reach ~~side and r~move the trapped chi~dr~n,-,be.~ar~: th~ approaching tra~n could s~rike the veh~cle. In m~ opina.on support~d by wa.tnesses, had Mrs. Betty Scheuermarm. s~epped back away..from the wrecked veh~.ele she wvu~d in a17. probability be alive today.
