AMENDING BUTTE COUNTY ORDINANCE N0. 506, KN04iN AS THE BUTTE COUNTY

Tha Board of Supervisors of the County of Butte, State of California
do ordain as follows: Section 3, and Section 4 of Butte County Ordinance
No. 506, known as the Butte County Setback Ordinance, are hereby amended
to read as followss
SECTION 3. A building line setback is hereby established along each
side of every street, highway and road which is dedicated to the public use
and is within the unincorporated area of this County. Such building line
setback shall be and it is hereby located parallel to and on both sides of
the established centerline .of each such street, highway and road; and the
space between the setback lines on either side of each such street, highway
and road shall constitute the setback zone. The setback lines and zones
are hereby established as follows:
(a) The setback line upon and along federal aid secondary routes
now existing or hereafter established in Butte County shall be distant fifty-
five (55} feet from and on both aides of the established centerline of each
such route; and the space between the setback lines on either side of each
such route shall constitute the setback sons for such routes which shall be
one hundred ten (110} feet in width.
(b) On all other streets, highways and roads dedicated to the
public use and within the unincorporated area of this County and along and
adjacent to the same, the setback line shall be and is hereby located parallel
to and distant fifty-feet (50) from and on both sides of the established
centerline of each ouch street, highway and road, and the space between the
setback lines on either side of each such street, highway and road shall
constitute the setback zone along and adjacent to the same, which shall be
one hundred feet (100) in width.
SECTION !~.
(a) It shall be unlawful to install or erect, within any setback
zone, any building, device or structure whatsoever, including but not limited
to derricks, windmills, silos, outdoor motion-picture screens, advertising
structures, signs, barns, houses, outbuildings and platforms; or to dig,

excavate or install within any setback zone aqy well or other excavation
whether for water or for oil or other hydrocarbon products or for any other
purpose; or install sub-surface structures of eny kind; save and except as
hereinafter provided in this Section.
(b) Thia section shall not apply to trees, agricultural crape,
open fences or public utility installations (exclusive of permanent buildings)
erected under authority of law, nor to sub-surface leaching and drainage fields
of private septic systems approved by the Butte County. Director of Public
Health and the Butte County Director of Public Works.
(c} Non-canformin6t uses. This ordinance shall not apply to any
building; structure, well, excavat~.on or sub-surface structure in existence
within the one hundred (100) foot setback zone as of the effective date of
Ordinance No. 506; nor to any building, structure, wall., excavation or sub-
surface structure in existence as of the effective date of this Amending
Ordinance, fronting upon federal aid secondary routes in this County, and
lying within the said one hundred ten (110) foot zone hereby established
upon and along said routes but exterior to the said ane hundred foot (100}
zone; all of which existing buildings, structures, wells, excavations and
sub-surface structures, as hereinabove in this sub--section specified, shall
be deemed to be son-conforming uses.
This ordinance, being an amendment to Butte County Ordinance No. 506,
and it is hereby decittred to be, in full force and effect from and after
thirty (90) days after the date of its passage, and before the expiration
of lifteen (15) days after its passage, this ordinance shall be published
once, with the names of the members. of the Board of Supervisors voting for
and against it, in Biggs-News , a newspaper published in
the County of Butte, State of .California.
