to annex the fo~lowing described property to County Service Area No.
23 for the pur~,ose of allowing draina~e therefrom to f~ow into Covnty
Service Area No. 23 drainage Facili~ies, and;
ti~IEREAS, said drainage facilities wer~ originally constructed
by assessment district proceedings,and;
WH~REAS, the Local Agency ~orrna'~ion Com~nission of the Coun~y
of Butte has approved said annexation provided that the property
owners pay into the S~rvice Area P2aintenance Fund an amoisnt equal to
what their assessment would have been had the property been part of
the assessment district at the time of its formation, anc~;
Wfi~REAS, said Commission has authorized this Board to
annex said property without f~irther notice, hearing or electiana
NOS~, THEREFORE BE IT RESOLV'ED by this Board as follows:
that the fol.Iowing property to be annexed is hereby annexad to County
Service Area No. 23:
A portion of Lots 38 and 39 according to that certain map
entitled "Hobart Subdivision of the Daniel Eidwell Rancho"
which man was recorded in the Office of the Recorder,
County of Butte, State of California, on Navember 7, 3.904,
in Bootc 4 of Maps at page 24, and more particu~ar].y described
as follows:
Beginning at the most Westerly corner ot said I~ot 38, which
point is the centerline of Burnap and Lassen Avenues; thence
North 51° 56' F.ast 278.50 £eet along the Northwesterly line
o~;~said Iot and the centerline of said Lassen Avenue; thence
South 38° 04' East 695.08 £eet to a point in the Westeriy
line of the Ca.ty of Chico Sacramento North.ern Railway Right
ot Way; thence South i5° 52' 35" West 344.49 feet along the
Westerly line of said righfi of Taay to a point on the centerline
o~ Burnap AvEnue; thence I~orth 38° 04' tidest 897.84 f'eet along
~he centerline of said Burnap Avenue to the point of beginning,
containing 5.10 acres more or less.

B~ IT FURTHER RESOLV~D that, as a condition to said
annexation, the owners oF the above-described property shall pay ~nto
the Service Area Maintenance Fund an amount equal to wha~ t~eir
assessmen~ wnuld have been had the property been part of the assessment
district at the time of its formation.
