AUTHOR~ZING EXECUTION OF AGREE^4ENT

County of Butte, State of Californa~a, that MURRAY & MCCORP4ICK,
INC., b~ and they are hereby appointed as Project FnginEer £or
the doing of all necessary engineering work and exeYCising ali
of the engineering functions provic~ed for under the pzovisions
o~ the Niun~.cipal Im~rover~ent Act of 1913 in connection with
the impzavements and acquisitions to be made in groposed
Paradise Pines Units No. 4 and 8~ssessment District, County of
Butte, State of_ California; and
B~ ~T F6RTHER RESOLV~D that the employment of the
said P2URRAX & MCCORP~iICK, TNC. , shall be, as provided in the attached
agreement; and '
BE z`P k'URTFiER RESOLVED that the Chairman of the Board of
Supervisors be authorized to sign, and the County Clerk thereof
be authorized to attest, that c~r~ain agreement employing the
said MLIRRAY & MCCORMICK, INC „ as Project Engineer for said
assessment district.

I HEREBY CERTIFY that the foregoing resolution was duly

A G R E E M E N T '
TH~S AGRE~~7ENT, made and entered into this 4th day
of May, 1971, by and between the County of Butte, a political
subdivision of the State of California, hereinafter called First
Party, and MURRAY & MCCOI2MICK, INC., a California corpor.ation,
hereinafter called Second Paxty;
W 2 T N E S S E T H~
That for and in consideratio~ of the mutual covenants
and agreemen~s herein contain~d, the partzes hereto agree as
follows:
1. Firs~ Party proposes to ir~itia~e special assess-
ment proceedzngs for the improvements and acquisa.ta.ons in
Paradise Pines Units No. 4 and 8~lssessment District, Butte County,
California.
2. Firs~ Party employs Second Par.ty as Project Engineer
for the dozng o~ all necessary work and exercising all engineer-
inc~ functions pr.ovzded for by the provisions of the Munici~al
Improvement Act o~ 1913 in cannection with the said improvements
and acquisi~.ions to be made in said district. Said services
shaTl include the £ollowing: -
a. boing of all necessary engineeri.ng work and
exercising of ali engineering functions pro-
vided for under th~ provisions o~ the Muni~
cipal Improvement I.ct of 1913;
b. Preparation and furnishing of al~, surveys,
' original drawings, maps and blueprinfis, p~.ans
and specifications, preparation of assessment
' zoll, assessment diagram, and any and aIl
o~.her serv~ces which may be rec{uired under
the provisions of the said Municipal Tmprove-
;ntent Ac~ of 1913;
c. Supervision and direction of all enqineering
work required to be ~aken by First Party or
its officers, agents or employees, in con-

nection with said improvements. Saicl duti_es
sha11 include furnishing, on or befare the
date fixed far filing of the Engineer's
ReporL•, a list of the names and addresses
of all property owners within tlie bound-
aries of the district as shown on thE last
equalized roll for taxes or as known to
the Engineer. Said list shal~ include
cpordination of the naMe and address with
the assessment an~ diagram number, and the
pzoper description of the property or the
County Assessor's parcel number of each lot,
piece, or parcel of land shown on the assess-
ment diagram~ when appropriate.
d. Rendition of general consultatzon and advice
to Fzrs~ ParL•y, its officers, agents, or
employe~s ~~ith respect to the p~anning, pre-
paration and hand.ling of a~l engineering phases
of the aforesaid proceedings; ~
e. Attendance a~ such conf.erences and pubXzc
meetings witih First Party as may be reasonably
necessary to perform this contract of emp~oyment.
3. Second Party shal~ receive compensation for the
above services as fo~lows:
The sum of $124,?.27.50.
The above amount shall be pai_d by First par~y out
of the proceeds of assessments levied and bonds to be issued
in said proceedings. '
4. In the event said proce~dings are not carried
through to conclusion, or shall be abandoned, then Second Party
shall receive nothing.
IN WITNESS wHEREOF, the parties have h~reunto subscribed
their names, First Party by its Chairman of the Board of Supervisors,
attested by its Coun~y Clerk, the day and year in this agreement
first above wri~ten. •
