RESOLtI`PION CALLING A PUBLIC HEARING ~0 DETER.MLNE WHETHER
PUBLIC NECESSITY, HEALfiH, SAFE~TY OR WELFARE RF}aUIRE THE
F:QRMATION OF AN tTi~TDEftGROUND UT2LSTY DISTRICT ON EAST AVENUE
BE IT RESOLVED by -~he Board o£ Su.pervisors of the County of Butte, as follows:
WIiEREAS, Ordinance No. 9$~ establishes a procedur~ for the creation of
underground utility dis~ricts and requires as the iaitial step zn such procedure
the 1no~.ding of a public hearing to ascertain whether public necessity, healthy
safety or welfare require the removal af poles, overhead wires and associated
overhead structures and the underground installation of wares and facilities
for supplying electric, communication, or similar or assoca.ated serv~ce in any
such district; and
WTi~R.EAB, it has been reco~mnended that such an undergrannd utility
districty hereinafter called DISTRICfi, be formed on East Avenue £rom the center-
line of PiJ.l.sbury Road to the centerline of State Highway 99 Freeway.
NOW~ TH~REF'OR~, BE IT RESOLVED AS FOLLOWS:
1. Notice is hereby given that a public hearing wiZl be held by the
Soard of S~pervzsors of the County of Butte on Jnne 29, 1971, at the hour of
11:00 a.m, in the Board o£ Supervisor's Room of the Gourthoase, Orovill.e, Cali.fo
to ascertain whether -~he pub7.ic necessity, h~alth, safety or welfare requise the
removal of pole.s, overhead wires and associated overhead structures and tHe
u.nderground ins~allation of wire and facilities for supplying electric, communi-
cation, or similar associated service in the District hereinabove described.
2. At such hearing, all persons interested snal]. be given an opportun'
to be heard. Said hearing may be continued from time to time as ~a.y be determin
by the Board of Supervisors.
3, The County C1erk sha7~J~ notify all affected property owners as show
on the l~st equalized assessment rol~ and utilities concerned o£ the ti.me'and
place of such hearing by m3iling a copy of this resolution to such property
owners and utilities concerned at least ten (10} days prior to the date thereof.

that certain map entitled East Avenue Underground Utility District No. 2, dated
May 1971 which is on file in the o~fice of the Caun~y Clerk of the County of
Butte.
