HomeMy WebLinkAbout71-126~so~u2raN No. 7~_~26 " RESOLUTION AND ORDER APPROVING AMENAED ENGZNEER'S ~ REPORT, ORDERING THE CONSTR~CTION Or IMPROVEMENTS AND ACQE3ISITIONS ANB CONFiRMING ASSESSfdENT, j pARADISE PTNES UI3ITS NO. 4 AND 8 ASSESS.*dENT DzSTI2ICT, [ SUTTE COLiNTX, CALIFORNTA WHEREAS, on the 4th day of May, 1971, the Board of Supervisors of the County of Butte, State of Cali.fornia, adopted i.ts Resolution of Intention in Paradise Pines Units No. 4 and 8 ~Assessment bistrict, Butte County, Califosnia, for the construction of improvements and acqu3sitions in said assassment district ~and re~erred said proposed improvements and acquisitions to the'Director of Public GJorks of Butte County, California, as Engineer of S9ork for said assessment district; and WHEREAS, on the 4~h day of May, 1971, the said Engineer of work filed an Engineer's Report, Assessment and Assessment Diagram in accordance with said Resolution, and said Engineer's Report was presented to the Board of Supezvisors of the County of Butte for consiaeration; and WFiEREAS, on the 4~h day of May, 1971, the Board of Supervisors of the County of Butte preliminarily adopted said Engineer's Report and fixed Tuesday, the 8th day of June, 1977., at the hour of 10:30 o'clock A:M. of said day, at the meeting glace of the Board of Supervisors of the County of Butte, located in the Sutte'Cvun~y Courthouse, Oroville, California, as ~he time and place for hearing protests with relation to saa.d pro- ~ posed i~nprovements and acquisita.ons; and ~ ~ . WHEREAS, pursuant to said Resolution hereinabove men-- ti.oned a Notice of Improvement was duiy published, posted and mailed, giving notice of the time and p~ace of heari.ng on said Report; and . -1- ~~. ~~ ~ 7~` ~z~ e WfiEREAS, an the 8th day of 3une, 1971, sa3.d hearing was held and consideration of sai.d matter was continued to the 22nd day of June, 1.971; and ~ ~ WHEREAS, on the 22nd day of June, 1971, sai.d hearing was held; and V1FI~REAS, all protests having been overruled; and ' WHEREAS, on the 22nd. day of June, 1971, the Boazd of ' Supervisors of the County of Butte directed the Engineer of Work tio file an Amended Engineer's Repor~; and WtiEREAS, on the 22nd day of June, 1971, the Engineer of Work filed with th~ County Clerk of the County of Butte ~ an Amended Engineer's Report; ' NOW, TH~REFORE, BE IT RESOT.VED by the Board of Supervisors of the County of Butte, State of Ca~ifornia, that this Board does hereby find, determine and order as foilows: ~ 1. That the district benefited by said improvemen~s and acquisitions and tn be assessed ta pay the costs and expenses thereof, is more garticularly described in the Resolution of Intention hereinabove referred to and made a part hereof by . reference thereto. That all public streets and highways within said assessmenti district, the same being in use in the perform- ance of a public function as such, shall be omitted from said district and from the levy and'collection of the special assess- . ments ~o be hereafter ].evied and collected to cover the costs and expenses of said improvements anci acquisitions. 2, Tha~ the pians and soecifications for the pro- posed improvements and acquisitions be, and they are hereby, finally adopted and approved as the p3.ans and specifications „ to which said work shall be done as called fox in said Reso~ lution of Intention. ~x~ ~ 3. That the Amended Estimate of.Cost of the itemized and total estimated cost and expenses of the improvements and acquisitions, and of the inczdental expenses in connection there- jwith, which said Amended Estimate of Cost is on file with the: I County Clerk of the County of Butte be, and iti is hereby, fi- na11y adopted and ap~roved as the ~ngineer's total and detailed estimat~ oE the aasts and expenses of said improvements and acquisitions. 4. That the public convenzence and interest require, ' and said Board hereby orders the improvements and acquisitions to be made as described in, and in accordance with, said Reso- ~ lution of intentioa, and the Amended Engineer's Repprt on file with the County Clerk of the County of Butte, reference to both of which is hereby made for a more particular description of said imgrovements and acquisitions and also reference is hereby ~ made to the provisions ot the Municipal Improvement Act o£ 1913, as amended. 5. That ~he amount to he assessed against each of the parcels or subdivisions of land shown on the Amended Engi- neer's Report does not exceed 75b of the market value of each of the properties assessed after the construc~ion of improve- ~ ments; that the appraisal of the maiket value o~ the proper- ties to be assessed on file in these proceedings is hereby adopted as the market values of each of said parcels. 6.~ The Board of Supervisors of the County of Butte i does hereby;levy and appor~ion upon each and every lot, piece and parcel of land withzn the boundaries of the assessment dis- trict ~he amaunt by which each of said lots, pieces or paxeels of Iand i.s benefited by the improvements and acquisitions. -3- The amount of the assessment which is levied and apportioned upon each and every lot, piece and parcel of land within the boundaries o€ the assessment district is as shown on the assess- ment attached to and made a part of the Amended Engineer's Report ~ adopted by this Resolution. The Boaxd of Supervisors of the Coanty of Butte hereby finds and,determines that each of said lots, pieces or parcels of land within the boundaries of said dis- ~rict is benefited in the amaunt and in the proportion of the total cost of the improvements and acquisitions, plus incidental i expenses, which each of said lots, pieces or parcels of Iand ~has been assessed in said Amended ~ngineer's Report. 7. Collections of assessments shall be made by the County Treasurer of the County of Butte. , 8. In the event any surplus remains in the Improve- ment Fund after the completion of the improvements and the paymen~ of a11 claims from the Improv~~ent Fund, said surplus shall be distributed in accordance with Section 10427 of the Streets and Aighways Code. * ~* * I IIEREBY CERTIFY that the foregoing resolution was duly ~,nd regularly adopted by the Board of Supervisors af the County of Butte, S~ate o£ California, at a regular meeting thereof, he3.d on the 22nd day of June, 1971, by the following vote, to wit: ' AYES: Supervisors Gi].man Madi an Maxon McKillo n Reynolds I30ES: 5npervisors None _ ABSENT: Suoervisors None ~ CLARK A.
