BE IT RESOZVE- by the Board of Supervi.sors of the County of BuCCe as

WHEREAS, by resolution dated .Fune J., 1971, a public hearing was called
for on 7une 29~ 1971, at the hour o£ 13.:00 A,M, in the Board of Supervisors
Room in the Courthouse, Oroville, Cali~orni.a, to ascertain whether ~.he public
necessity, heal~h, safety or welfare requires the removal of poles, overhead
wires and associated overhead structures, and Che underground in.stalZation of
wires and facilities for supplying elecCric, communication or similar or
associated service, within Chat certain area of the county described as follows:
Beginning at the inCersec~ion of the centerline of East Avenue (60 €eet wide)
with ~he centerline of Pi1].sbury Itoad {60 feet wide); thence souther7.y a7.ong the
centerline of Pillsbury Road, 205.07. feet to the easterly proiongation of the
northeely line of Lot I4 of tFie ~'airview Manor Subdiva.si.on, zecorded in Book 34
of Maps at page 22; thence westerly along said easterly pro7.ongation and the
northerly line of Lot !4 to the easterly right of way 7.ine o£ the Sacxamento
Northern Aailroad; thence northerly along said easterly rai7.road xight of way
line to a point distant southerly 75 feet from the cente~line of East Avenue;
thence westerly para11e1 with the centerline of East Avenue to the westerly
line of the 12 foot PUE (Public U~i].ity Easement) on the easterly line of Lot 1
of the Rancho Lindo Subdivision, Unit No. 1, recoxded a.n Sook 19 of Maps at

~8 interested have been given an opportunity Yo be heard,
~g NOGI, TIiEREFORE, B~ zT RESOLVED bq Che Board of Supervi.sors of the County
20 of Butte, that, pursuant to Ordinance No, 981 of the County of Butte, Che
21 above-described area i.s hereby declared an T7nderground Uti7.9.ty District, and
22 is designated as ~ast Avenue Underground Utility District No. 2 of the County
23 of Butte. Attached hereto an& hereby incorporated as a part of this resolution
24 is a map delineati.ng t~e boundaries of said District;
25 RESOLVED~ FUR~HF~2~ THAT T~IE B4ARD OF SiTPERVIS~RS does hereby fix March 1;
26 1972, as the date on which affected property owners must be ready ~o receive
27 underground service and does hereby order the removal o£ al.l poles, overhead
28 wires and associated overhead structures and the underground insYallation of
29 wires and facilities for supplying electric, communication, or similar or
30 associated serviae ~*ithin East Avenue Undergxound Uti3.ity Distric~ I3o. 2 on or
37. before April 1, 1972;
32 RESOLVED, FURTHER, that ~he County Clerk is hereby instrucead to notify
all a~fected utilities and all persons ozaning real propezty within Easti Avenue

Underground UtiiliCy DisCrict No. 2 of the adoption of this resolution within
ten (10) days after the date of such adoption. Said County Clerk shall further
notify safd property owners of the necessity that, if they or any person
occupyfng such property desire to continue to receive electric, communication,
or other situilar or associated service, they or such occupant sha~.1, by the
date fixed in this resolution, provide a11 necessaxy facility changes on theix
premises so as to receive such services frnm the lines of the supplying utility
or uCiliCies aC a new location, subject ~o applicable rules, regulaCions~ and
~ariffs of the respective utility or utilities an file witE~ the Public Utilitie;
~,ominission of the State of California. Such notification shall be made by
mailing a copy of Chis resolution together with a copy of said Ordinance No.
981~ to a11 affecCed property owners as such are shown on the last equalized
assessment roll and eo the affected utilities;
RESOLVED~ F[3RTHER, thaC the Board of Supervisors hereby finds and
determines as follows:
The Llnderground Tftility Dzstrict herein creaeed is in ~he generai public
interest for the following reasonso
(1) "The undergrounding to be accomplished will avo~d or elimina~e
an uausual.ly heavy concentration of overhead distribution
~acilities;"
(2) "The stxeets, roads, or rights of way in the ]Jistrict are
extensively used by the general public and carry a heavy
volume of pedestrian or vehicular traffic;"
(3) "The said streets, roads, or rights of way adjoin or pass
through a ca.va.c area. ~~
