BE IT RESOLVEA by the Baard of Supe~visors of the County of
Butte, State o~ Cali~ornSa, tha~ said Board fin.ds and determines and
hereby declares, as follows, to wit:
1. That public interest and necessity requi.x~e the acquisitzon,
construction and completion by the County of Butte~ o~ a pub].ic
improvement, namely, a county highway known as Skyway in. the County
of Butte, State of Californiao
2o That public interest and necessity require the acquisi~.ian
for said improvement of ~he real property, or interest in the real
property hereinafter described, together with all improvements
situate thereon, and it hereby found and determined that the con~
struction of a cou.nty highway is a public use, authorized by law, and
that public interest and necessity require the construc~ion af
said improvements and the acquisition of said real property hereinafter
described, and a11 improvements sztuate thereon.
3. Said proposed public 9.mprovement is planned and located
in a mannex~ which wi11 be mos t compatible with th.e greatest public
good and tlze least publie injury.
4. That the County Counsel af the County ot Butte is hereby
authorized and empowered as follows:
(a) To acquire, in the name of ~ne County of
Butte, a fee sitnple estate or such necessary interests in and to the
hereinafter described real property, or interest in real prop erty,
and a11 improvements thereon by condemnation in accordance with
the provisions of the Streets and High~c,ray's Code, Code of Civil
Procedure and the Constitution of ~he Sta~e o£ California, relating
to :eminent.domain, ta authorize the auditor to payfxQm County funds.

the costs and consideration for s~ch acqu~sition, and the auditor
is authorized to make such payment on authorization,
(b) To prepare and prosecute for the County of
Bu~te, such proceedings zn the proper court having jurisdiction
thereof, and make such deposits from County tunds for fees and costs
as are necessary far s~ch acquisition,
(c) To make app~ication to said court for an
order fi~ing the amount of security in the way af moneys deposited as
said court may direct, and for an order permitting the County of
Butte to take immediate possession and use of said real ~roperty,
or interest, or improvements in said real property, as a righ~ of
way for a public highway for public use. ~
(d} ~o make deposit of such security out of
proper funds under the control of the County of Butte, in such
amounts as fixed and determined and in such manner as said court in
which condemnation proceedings are pending may dzrec~ and tne Auditor
is authorized to make said deposit immediately upon ~he court making
said order.
5. That real property, or interest in real property, and/~r
improvements thereon, which the County of Butte,is, by ~his
resolution, authorized to acquire for said public improvements in
fee simple, is situate in the County of Butte, State of California,
more particulariy described in ~xhibit '"'~" attached hereto and made
a part_ hereof by reference as ~f set forth in fu11o
