ELECTION AND AppOINTING OFFICERS TO CONDUCT SAID ELECTION; AND PRO'VIDFNG FOR NOTICE THEREp~' • WHEREAS, the Board of Supervisors o~ ~he County of Butte Yias cluly passed and adop,ted a resolution declar- ing the necessity for Butte County Service Area No. 26 to incur a bonded indebtedness, stating the purpose for which ;,.the proposed bonded ~ndebtedness is proposed to be i.ncurred . ' .. 7/-~6/ and the amount thereof, and fixing a time and place°of.hearin~ thereon; and ~ wHEREAS, notice of such hearing has been duly qiven and said hearing has been duly held in the manner and for the time prescribed by law; and wHEREAS, this Board of Supervi5ors, by resolution duly passed and adopted, ~ias determined that the whole pf the county service area would be benefxted by the accomplishmen~ of the purpose thereiri~ ! stated and by thc isau~zncc of bonds in L-hc amount therein sc~ torth; WHEREAS, the Board of Supervisors have entered into a Joint Powers agreement between the County of Butte, County Service area No. 26 and the Thermalito rrrigation Distxzct for financing • construction and operation of sewage facilities serving the area wzthin Butte County Service area No. 26; and NOinT, TI3E12~FOR~, IIE I'T F2~SOLV~D BY THE BOARD 0~' SUPERVTSORS OF TI-I~ COUNTY OF BUTTE, 715 FOLLOWS: l. The foregoing recitals are, and each of .them is, ~rue and correct and this Board so finds and determines. 2. This Board deems it necessary to incuz a bonded indebted- ness in the amount o£ $700,000 for the purpase hereinaf~er set forth; and this Board so finds, determines and declares., _ 3. The purpose for which said proposed debt is to be ' incurred is to provide, caith~.n, the county service area sewage service, requiring the construction and instailation of £acilities for the collection, treatment and disposal of sewage of Butte . County Serva.ce Area No. 26 and its inhabitants, comprising treatment ~ facilities, outfall lines, pumps, machinery, trunk lines, lands, easements, rights ot way, and other works, proper~y or structures, useful or necessary for the co7.lection, treatment or~disposal of sewage of said Butte County Service Area No. 26 and its inhabitants. 4. The whole of the aounty service area will be benefited by the accomplishment of said purpose and by the zn.cuzra.ng of said bonded indebtedness, all~in accordance with the deterznination of , "the Board as earlier expressecl. 2. 5. The principal amouilt of th~ dEbt to be in- curred for said purpo~e is $700,000. 6. The maximLim term the bonds to be issued shall run before maturi~y shall be 40 years after the date of said bonds. 7. The rate of interest to be paid on said bonds shall be seven per cen~ (70) per annum, payable annually for the fir5t year and semi-annuaily thereafter; provi~ed that said bonds may be offered for sale at any lawer rate of interest, but not in excess of seven per cent (7~) per annu~, pa~able as aforesaid. 8. The measure to be submitted to the electors of the county service area shall be as follows: r ~ASURE: Sha1~ Butte County Service Area No. 26 incur a bondea indebtedness in the sum of $700,000 for the puxpose of the acquisztion, construction and completion o~ facilities £or the collec- tion, treatment and disposal of sewage of Butte County Service Area.No. 26 and its - inha~itants, compriszng treatnient facilities outfall Iznes, intercepting ~ines, trunk lines, pipes, pumps, machinery, lands, easements, rights of way, and other works, pzoperty pr structures, useful or necessary for the collection, treatment or dzsposal of sewage of said Bu~te County Sexvzce Area Na. 26 and its inhabitants? . 9. A special bond election is hereby called and ozdezed to be held in the county service area on Tuesday,. Sept.: 28 , 1971, at wh~ch election there sha11 be sub- mitted to the qualzfied electors of the county service area ', the measure hereinabove set for~h. This Board does hereby submit to the quakified elec~ors~of the county, service area at said special bond election, the said measure and designates and re~ers therefo in the ballot hereinafter prescribed for use at said elec~ion. ' 3. 10. The po11s at the polling place hereinafter mentioned sha11 be op~ned at seven o'clock A.M. and shall be kept open continuously thereaf~er until seven o'clock P.M. on the day of said elec~ion, when said polls shall be closed (except as provided in Section 14435 of the Elec- tions Code of the State of California), and the.elec~ion officers shall thereupon proceed to canvass the ballots ~ cast thereat. ~~.
