HomeMy WebLinkAbout71-204BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that said Board finds and determines and hereby declares, as fol].ows, to w~it: lo That public interest and necessity require th.e acquisition, construction and completion by the Cov.nty of Butte, of a public improvement, namely, a coun.~y highway known as East Avenue in the County of Sutte, State o~ Californiao 2o That public interest and necessity requ.ire the acquisition for said improvement af the real property, or interest in the real property hereinafter descri~d~ed, together with all improvements situate thereon, and it hereby found and determined that the con- struction of a county highway is a public use, authorized by law, and that publie i.nterest and necessity require ti~e construction of said improvements and the acquisita.on of said real property herein- after descxa.bed, az~d al1 improvements situate thereon.. 3o Said proposed public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least publ.ic injurya /~, That the County Counsel of the Coun.ty of Butte is hereby authorized and empowered as follows: (a) To acquire, in the name of the County of Butte, a fee simple estate or svch necessary interests i.n and ~o the hereinafter described rea]. praperty, or interest in real property, and aIl improvements thereon by condemnatzon in accordance with the provisions of the St~eets and Highways Gode, Code of Civil Procedure and the Cons~itution of the State of California, relating to emi~zen.t domain, RESOLUTION AUTHORIZING ACQUISTTION OF REAI, PROPERTY SY EMINENT DOMAIN NECESSARY FOR 'I"~TE CONSTRUCTION OF A COUNTI' HIGHWAY RNOWN,AS ~AST AV~NUE IN THE COUNTY OF BUTTE, STATE OF CALIFORNIA consideration for such acquisition, and the auditor is authorized to make such payment on authorization, (b) To prepare and prosecute for the Covnty of Butte, such proceedings in the proper court having jurisdiction thereof, and make such dep:osifs:> from County funds for fees and costs as are necessary for such acquisition, (c) To make agplication to said court for an order fixing the amount of security in the way of moneys deposited as said court may direct, and ~or an order permitting the County of Butte to take immediate possession an.d use of said ~eal propearty, or interest, or , improvements in said rea~ property, as a right of way for a public highway for public useo (d) To make deposit nf such security out o~ proper funds under the control of the County of Butte, in such amounts as fixed and determined and in such manner as said court in which condemnation proceedings are pending may direct, and the Auditor is authorized to make sa.id deposit immediately upon the court makin.g said order. 5.
