2I-54 that Rule 7. of Appex~dix "A" to Resolution No, 71-136 is
amended to read as follows:
7. NOTICE OF HEARING. (a ) After the filing of an
application, the cler s a11 set t einatter for hearing and not~.fy
the applicant of the time and place of the hearing in writing, not
less than ten days priar to the hearing on the form approved by
the Board of Supervisors, by personal delivery ta the person
affected or his agen~ or by depositing the notice in the United
States mail directed to the person affected or his agent a~ the
address designated in the application. The notice required to be
given by these rules to ~.he person affected or his agent may be
waived by the person affected or his agent and the assessor in
writing in advance of the hearing, or orally by the person a~fected
or h.is agent and the assessa~r a~ the time of the hearing.
The notice sha11 also include a sta~ement that the
board is required to find the full cash ~cralue of the property f~om
the evidence presented at the hearing and that this finding may
ea~ceed the full cash value on which the assessment was based,
with the result that the assessment wi.ll. be raised ~ather than
lowered.
(b) Th.e notice of the time and place of hearing
on postponed hearing shall be given nat less than ~en days priar
to ~he hearing unless notice has been wai~ved or" a shorter
notice is stipulated to by the assessor and the person affected
or his agent.
(c) The clerk shall notify the assessor and tne
county legal adv~.sor of the time and place of the hearing at the time
of, or prior to, the giving of notice of hearing to the person
affected or his agent.
(d) When the board on motion proposes to raise the
assessment of property without an app7.ication pendin~g befare it,
notice of the time and place o~ hearing sha1l be given to the
assessee of the property appearing on the Iocal ro17. in the manner
provided above at least 20 days prior to the hearing.
BE IT FURTHER R~SOLVED that the form o£ notice
attached hereto as Appendix "A" is hereby appraved for use by the
RESOLUTION AMIIJDING RULES OF NOTICE AND
PROCEDURE OF THE BUTTE COUNTY ASSESSMIIQ~
APPEALS BOARD
