TOPICS PROGRAM 2N CHICO URBAN AREA
BE IT ~SOLVED by the Board. o~' Supervisors of the County of Bu~-~e,
State o£ Cal.ifornia, as follows:
1. This County enters into the attached Cooperative Agreement be-
tween Coun~y of Butte and City of Chico relative to participation in the TOPICS
Program in the Chzco Urban Area, and the Ghairman of the Board is authorized
to execute saa.d agreement on behalf of said County:
2. That C1erk of this Board be authorized to attach certified copy
of this resolu~tian to said agxeement.

COOPERATIVE AGREEMEIVT BETWEEN COUNTY OF BUTTE
AND CITY OF CHICO RELATIVE TO PARTICIPATIOi~T
IN THE TOPICS PROGRAM
THIS AGREEMENT, made and entered into this «~''~day
of September, 1971, by and between the CITY OF CHICO, a municipal
corporation of the State of California, hereinafter called "City,`
and the COUNTY OF BUTTE, a political subdivision of the State of
Calitornia, hereinafter called "County,"
RECITALS
1. This agreement is c~.ade with reference to the Federa7
Aid Highway Act of 1968, and in particular the provisions.thereof
entitled "Traffic Operations Program to Increase Capacity and
Safety," ~e£e~rred to as TOPICS, and Chapter 1141 of the Statutes
of 1969 of the State o£ California.
2. ~t i.s the desire o£ the City and County to partici--
paee in sai.d TpPICS program, to which funds have been allocated
for needed improvement projeces in the Chico urban area.
3. That in order ko qualify for participation in said
program for the mutual benefi.t of both City and County, it is
necessary to define and establi.sh respective xesponsibilities,
bene~irs, and cos~ sharing formulae;
NOW THEREF~RE, IN CONSIDERATION OF '~HE PRLMTS~S AND TH~
NNTUAL COVENANTS HEREINAFTER CONTAII~ED, IT IS AGREED AS FO~L~FiS:
1. That the respective parties hereto agree to jointly
participate in the aforementioned TOPICS program, and wi11 forth-
with, through the duly authorized officers of each agency,
execute a11 agreements, and prepare and file a11. materials
required of each agency to meet the requirements of both the
State of California and tlZ.e federal government to qualify tor
said program.
2. It is understood that the term "local agency" as
used in said program will under this agreement mean boeh City and

Coun~y, and under this agreement City will function as the rep-
resentative of Che local agency for the entire Chico urban area
and wi11 represen~ borh Cou~ty's and City's interes~s in said
TOPICS program in negotiations with the SCate of Cali~ornia.
3. The City and the County, acting as the "Local
Agency" sha11 enter into a Local Agency--State Agreement with the
State ot Caiifornia, obligating the local agency to perform the
following items:
i~ (a) Develop and prepare an area-wide TOPICS P1an
and Study Report with respect to the consCruction,
maintenance and evaluation of those TOPIGS improvement
projects approved in conformance with the provisions of
PPM2~-18 of the U. S. Bureau of Public Roads.
(b) Develop both a preliminary and a f~nal Type
ZZ Federal Aid Primary Highway System for the Ch~co
urban a~ea.
(c) Prepare and develop a priority lisr of pro-
posed TOPICS Improvement Projects to be constructed,
maintained and evaluated in the Chico urban area.
(d) Maintenance and evaluation of completed
TOPICS Improvement Projects in a manner satisfactory to
the U. S. Sureau of Pub~ic Roads shall be the responsi-
bility of the Ciry for those projects lying within the
City portion of ~he Chico urban area, and the County
for those projects lying in the unincorporated portions
o~ the Chico urban area.
(e) That all items mentioned in subparagraphs
(a), (b), (c), and (d} above shall be reviewed and
approved by both City and County prior ta submitting
same to the State of California.
4. If traf~ic consultant services are required to
make and prepare comprehensive transportation planning studies

for rhe Chico urban area, an agreement may be entered into with
rhe State of California obligating the state and ehe "Loca1
Agency" to finance this study cost, with the staee to pay 85%
thereof, and the Local Agency 15% thexeof, the latter to be share
one-half by City and one-half by County, provided ehar no cost
I shall be incurred without prior app~oval of ~he srate and the
Loca1 Agency.
5. It is unders~ood that construction costs in the
TOPICS program wi11 be shared and financed between the state and
Loca1 Agency in accordance with a formula required by the State
of Califoxnia, wh~ch wi11 be approximately as follows:

6, When TOPICS funds are made available, City and
County agree to participate in the "Local Agency" share of design
and construction costs for the following projects upon a fzf~y-
fifty basis:
(a) Construction of East Fifth Avenue Bridge
over Lindo Channel (Estimated "Local Agency" cos~,
$37,700);
(b) Reconstruction of Manzanita Avenue Bridge
over Big Chico Creek in Bidwell Parlc (Estimated "Local
Agency" cost, $37,700);
(c) Con.stxuction of traffic signa~. and highway
li.ghting system at in.terseceion of Cohasset Road,
Pillsbury Road and Manzanita Avenue (Estimated "Loca1
Agen.cy" cost, $6,400);
PROVIDED, HOWEVER, th.at Che parties hereto shall, th~ough rheir
respective departments, share performance of design, engineering
and construction i.nspection £or the foregoing projeces in the

7. All work or costs incurred by either CiCy or
County toward the aforementioned projects prior to an a~reement
being made with the state under said TOPICS program, to t~.e
extent not recoverab].e under said program, sha11 be shared
between the parties hereto upon a fifty-fifty basis. Further,
should a bid or bids upon any project, or the cost of a project
exceed the amount budgeted therefor by either the City or Che
County, a bid shal~ not be awarded nor costs incurred in excess
of the amount so budgeted without the prior approval of tihe
parties hereto involved, such approval to be by action of the
legislative body of said party, through a supplecnental appropri-
ation or otherwise.
8. After a low bi.d upon a project has been determined,
contracts shall not be made until County has deposited with City
the proportion of the funds required to be contributed by
County under the terms o~ thi.s agreement. In other words, City
shall not, as representarive o~ the ~,ocal Agency as herein
defined,execute such contract, unless.saxd deposit is made prior
therero. Prov~.ded, further, however, in the event the provisions
~of paragraph niri.e herein are exercised, then and in that event
the deposits re~ezxed to herein, including the deposi~ to cover

Cify's share of costs herein, sha11 be made in like manner and on
the same conditions as provided herein to either the State or
the County, whichever the case may be.
9. Notwithstanding designation of City as representa-
tive of the Local Agency herein, should City find that it is
unable to fully carry out such representation, then, with approval
o~ ~he b~rector of Public Works of County and the City, either
the State or the County may be designated to carry out the
administration of the projects at the going rate for services
agreed upon between the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed by the respective officers duly authori-
zed b~ resolutions of the legislative bodies o~ the respective

(Federal Aid Highway Act o~ 1968}
WH~R~A,S, the Federal Aa.d Hi.ghway Act o~ 1968 provides
for a program en~itled "Traffic Opera~ions Program ~o ~ncrease
Capacity and SafeCy," referred Co as "TOPICS," and
WHEREAS, the State of California has adopted Chapter
~.i4~., Statutes o~ 19b9, by which federal funds authorized by the
TOPICS program may be made available for use on county highways,
city streets and city highways, to reduce traffic congestion and
~acilitate the ~'Iow of trat'fic in urban areas in accordance with
the intent o~ said federal act, whi.ch contemplates a cooperative..
agreement between cities an.d counties to implement said program,
and
WHEREAS, it i's in the public interest that the City of
Ghico enter into such agreement with the Countq of Butte for said
purpose, under a cost-sharing ~o~mula; now, therefore
BE IT RESOLVED BY THE COUi~TCTL OF THE CITY OF CHICO

AS FOLLOWS, TO WTT:
L That the City o~ Chico enter into a cooperative -
agreement with the County of Butte relative to ~articipation in
the TOPICS program in such form and contazna.ng such..conditions as
shall be approved by the City Attorney and the City Manager, but
containing substantially the following provisions:
(a) Whi1.e it is understood that both the city
and the county wi11 be required to enter into an agree-
ment with the State of California wherein both entities
will be referred to as "1oca1 agency" the city wi1Z
funetion as the "local agency" for the entire Chico
. urban a~rea, x~epzesenr~.ng the coun~y's interest therein;

, (b) Costs to be shared as fo~~ows:
(1) Traffic consultant services required by ~~
~he act - state, 85%; local agency, 15%, with the I
latter being shared 50/50 by the city and county;
(2) Design and construction costs - state,
71%; local agency, 29%, with the latter being
shared 50/50 by the city and county;

(2) Reconstruction of Manzan~ta Avenue
