HomeMy WebLinkAbout71-251BE IT RESOLVED by the Board of `Supervisors of the County o~' Butte, State of California, tha~ said Board finds and determines and hereby decJ.ares, as fo7.lows, to wit:. 1, That public interest and necessity require the acquisi~ tion, construction and completion by the County of Butte, of a public improvement, namely, a county highway knawn as East Avenue in the County of Butte, State of California, 2, That public interest and necessity require khe acquisition for said improvement of the real praperty, or interes~. in the real property hereinafter described, together with a11 improvements situate thereon, and it hereby found and determined that the construc~ ~ion of a county highway is a pubLic use, autho~ized by law, and that public interest and necessity require the construction of said improvements and the acquisition of said rea~. prope~^ty herein~ after described, and all zmprovements s~tuate thereon. 3. Said proposed public improvement is planned and located in a manner which wil], be mos~ compatible with the greatest public good and the least public a.njury, 4. Tha~ the County Counsel of the County of Butte is hereby au~horized and empowered as follows: (a) To acquire, in the name o~' the County of Butte, a fee simple estate or such necessary interests in and to the hereinafter described real property, or interest in rea1. property., and all improvements thereon by condemnation in accordance with the provisians of the Streets and High~s Code, Code of Civil Pracedure and the ~ Constitution of the State of Ca~ifornia, rela~ing to eminent domain, ,' to authorize the auditor to pay from county funds the costs and 7 /-1 S RESOLUTI4N AU'~FiORIZING ACQUISITIO~ 4F REAL PROP~~T.Y BY EMINEDTT DOMIaIN NECES'SARY FOR THE CQNSTR~(JCTION OF A COUNTY HIGHWAY KNOWN AS EAST IaVENtTE IN THE COUNTY OF BUTTE, STATE QF CALIFORNIA consideratian £or such acquisition, and the auditor is autho~ized to make such payment on authox~zation. (b) ~o prepare and prosecute for ~he County of Butte, such p~oceedings in the proper court having jurisdiction thereof, and make such deposits from County fcuids for fees and costs as are necessary for such acquisition. (c) To make application to said court for an order fixing the amount af security in the way of monies deposited as said court may direct, and for an order permitting ~he County of Butte to take immediate possession and use of said real property, or interest, or improvements in said real property, as a right~o~-way for a public highway for public use. (d) To make deposit of such seCUrity out of proper funds under the cont~ol o~ the County of Butte, in such amounts as ~ixed and determined and in such manner as said Caurt in which con- demnation proceedings are pending may direct, a~d the Auditor is authorized to make said deposit immediately upon the court making said orders. 5.
