Busineas and Tra~sporta~ion Agenay, Department of Public Works,
Divi~ion of Highways, hereinafter for convenience rePerred to
a~ the "State," and the CO~TATTY OF SUTT~, herei.nafter for
eonvenience referred to as the "County,"
WITNESSETIi:
WHEREA~, the Callfornia Highway Cotnmiasion k~as
adopted a resolution on Apr~.l 18, i951, declar~ng thati eertain
portion oF State Hlghway Route 99 1.n the Co~znty of Butte between
', Oroville Wye and CentervilZe Road to be a freewa,y; and
Wf~RLA3, the 5tate and the County have heretofoare
~xecuted a Freeway A~reement dated Ma.y 5, ],9'~0, w~.th, respect
to the gortion oP sald route between p.~4 m~.le south of' the ~ast
Rork of Robert~ Creek ~nd the Chico Cit~ ~,imit near Morrow Lane,
and
WIiEti~A,S, the plan for said freeway has since been
revi~ed in certain particulars, wi~h respee~ to said por~lon,
and a new plan ma.p has been pregared, ahowing the revised
plan of the State as it af'f'ects aounti~r road~, including
provisians for closing cotitraty roads, for carrying county

roads over or under or to a connection w3th such ~reeway for
relocation of eounty roads, and for cons~ruc~ion of frontiage
roads and other laeal roads:

1. Thla Agree~ttent supersedes the freewa.y agreement
da~ed Aqay 5, 1974, in its entiret~r. Zn lieu therea~', the
Coun~y a~rees and consents to the elosing of count~r roada,
reloca~ion of county roads, constructi.on of frontage roads
and other loca7. roac~s, and other canatruetlon aft'eetin~ eoun~y
road$, all as shown on the plan map attached hereto ma.rked
"Exh3bit A," betvaeen 0.4 mile south of the Ea~t Fork of
Roberta Cre~k and the City T,im3.t of Chieo approxicnately 0.3
mile south oP the Skyway Ov'srcroasi.rg and made a part hereof
by this reference.
2. The State in the construc~ion o~' ~aid freeway
wi.ll, at the Sta.te;s expense, make such changes affectin~
county roads in acaordanee with the said plan map attaahed
he~eto or as the same may herea~'ter be modified by mutual
a~reetnent bett~een the part3es here~o. ~'Yae State may, at the
State's expense, install si~ns, signals and other traffie
cnntrol dev9.ces at appropriate locations to be deterinined
by the State ia~ order to regulate, warn or guide traffic upon
the highways,
3. The 3tate agrees to acquire a11 necessary

the ~ront~ge roads and other S~ate cons~r~cted local roads on
nottce to ~~e County Road Go~missioner f~om ~he State that

thers~F whieh is adopted.by the Sta~e as a part of the ~reeway
proper. The Count~ wi12 also aceept title ta the portions of
s~ch roads l~~ng outside the freewa~ limits, upon rel~nquishrnent
by the S~atie.

will either be ttndearpasses or overpasses as detailed engineering
studies may de~ern~ine will bes~ fi.t ~che 1ocality. It is t~nd~r-
stood between the par~ies that the ri.ght of way may be aaquired
1n sect~.ons or uni~s and that, bo~h as to the acquisition of
right of ~ray and. ~h~ eonstruction of the #'reeway pra~ect, the
obli~atians of State hereux~der sha13 be carr3.ed. out at such
time and for such uni't or 'un~.ts of the pro~ect as funds are
bud~eted and made la~vfull~ available for sueh expend~.tures.
6. This agreement may be modified a~ any time by
the mutuay consent of the parties here~o, as m~y become

n~ceesary for the 3aeat aecomplishment thr~ough State s~nd Coun~~
caap~ration of the whole f~eeway proJect for the benefi~ ot' th~
pepple o~' th~ State and of the Caunty.
