RESOLUTION AUTHORIZING ACQUISITION OF I2~AL PROPERTY BY
EMINENT DOMAIN NECESSARY FOR TH~ CONSTRUCTION OF A
COUNTY HTGHWAY KNOWN AS FORBESTOWN ROAD II~ THE COUNTY
OF BUTTE, S~ATE OF CALIFORNIA
BE TT RESOLVED by the Board of Supervisors of the County of
Butte, State o~ California, that said board finds and determines
and hereby declares, as fol~ows, to wit:
1. That public interest and necessity require the acquisi~
tion, construction and completion by ~he County of Butte, of a
public improvement, namely, a co~nty highwray lcnown as Forbestown Road
in the County of But~.e, State of Californ9.a.
2. Tf-cat pv.blic interest and necessity require the acquisi-
tion for sa~.d improvement of the real property, or interest in the
real propexty hereinafter described, together wi~h ail improvements
situate thereon, and it is hereby found and determined that the
cons~r~ction of a county high*aay is a public use, authorized by
~aw, and that public interest and necessity require the construction
of said improvements and the acquisition of sai.d real property
hereinafter described, and all improvements situate thereon.
3. Sa~d:proposed public improvement is planned and located
~.n a manner which will be most compatible with the greatest public
good and the least public injury.
4, That the County Counse~. of the County o£ Sutte is
hereby authorized and empQwered::as fallows: .
(a) To acqtlire, in the name of the Court.ty of Butte, a
fee simple estate or sv.ch necessary interests in and to the
hereinafter described real property, or interest in real property, and
all improvements thereon by condemnation in accordance with the
provisions of tk~e Streets and Highways Code, CiviT. Procedure and ~he
Constitv.tion o~ the State of Californa.a, relating to eminent domain,
to authorize the auditor to pay from County funds the costs arri.

consideration::£or::such acquisition, and the auditor is authorized
to make such payment on autharization.
(b) To prepare and prosecute for the Co~nty of Butte,
such proceedings in the proper court having jurisdiction thereof, and
make such deposits from Cov.nty funds for fees and costs as are
necessary for such acquisitfon.
(c) To make application to said court for an order
fixing the amount of security in the way of moneys deposited as said
court may direct, and fox an order permitting the County of Butte
to fiake immediate possession and use of said real property, or
interest, or improvements in said real property, as a right of
way for a gublic ~~ghway for public use.
(d) To make deposit ~ such security out of proper
funds under the control of the County of Butte, zn such amounts as
fixed and determined and in such manner as said court in which
condemnation proceedings are pending may direct, and the Audi~or is .
autharized to make said deposit immediatelq upon ~he court making
said o~der.
5. The real property, or interest in real property, and/ax
improvements thereon, which the County of Butte is, by this
reso~ut~on, authorized to acquire for said public improvements in
fee simple, is situate in the County of Butte, State of California,
more particularly described in Exhibit "A", attached hereto and
made a part hereof by reference as if set forth in full.
PASSED AND ADQPTED by the Board of Supervisors of the County
of Butte, State of Calitornia, this 26th day of October , 1971,
by the following vote:
