ZT ZS HEREBY RESOLVE- by the Board of Supervisors of the County of
Bixtte, State of California, that Chairman of the Board is hereby authorized
and directed to e~ecute Right-of-Way Certification No. 3 dated
'Uecember 14 , 1971, in the name of the County o€ Butte.
Be it further resolved that the County of Butte agrees to hold the
State of California harmless from any 7.iabi7.ity which may resuJ.~ a.n the event
the rfght of way is not clear as certifiedo If the State i.s named i.n a damage
suit, as a result of the right of way not being clear as certi.£a.ed, the County
of Butte agrees that, at the request of the State, it wi7.7. assu-ne £u].1 respon-
sibility for the conduct of the defense or provide such assistance as ~the
State may require and wi11 pay any judgments issued against the State and all
costs in connection with the defense.
