UN~T NO. 4 ASSESS£~LEN'Y' DISTRICT, BUTTE COUNTY, CALIFORNIA
BE I~ ItE50LVED by the Board of Supervisors of the County
of Butte, State of Californi.a, that it is the intentiQn of said
Boazfl of Supervisors to order the foZlowing impsovements and acqui-
si.~a.ons to be made in Paradise Pines Country Club Estates Unit No. 4
Assessment bistrict, Butte Caunty, California, to wit:
The constructi.on of s~reets, including cZearing,
excavation, grading, base pavement, roadside and out-
fall drainage, pipes and ditches, together with all
necessary inlets, manholes,.barricafles and other
appurtenances for a complete scheme of street improve-
ments and storm drainage facilities within the boundaries
of said proposed district.
Clearing, excavation., grading, paving, together with
the construction of new driveway cnnnections and
- installation of paved gutter and drainage pipes, as
~ needed, for completion of the reconstruction of an
existing road, referzed ta as 4ti~oodpecker Ranch Road
but now to be called Compton Drive, tha~. exten3s from
the southerly boundary of Paradise Pines Unit No, i5
to the northerly boundary of Paradi.se Pines Country
C].ub Estates Unit No. 4.
Clearing, excavation, grading, pava.ng and installation
of a system of domestic water supply i,ncluding fire
hydrants, valves, services and a13. other improvements
and appurtenances necessary for a complete saheme of
domesti.c water supply faci3.ities within the boundaries
of said p~oposed district~.
The acquisition of a1.1 necessary rights-of-way to
accomplish the foregoing for a complete scheme of
improvemen~s within the boundaries of said proposed
district.
BE TT RE50LVED that said improvements to be constructed
in the streets, avenues, lanes, courts, roads, places and/or public
ways hereinabove described, will be ot dimensions, materials, and
in the particular locations, as set forth and shown on the plans
and specifications and detailad drawings hereinafter referred to;
together with the construction of a11 ap~urtenances thereta, includ-
ing necessary fittings, t~enchings, grading and regrading, excava-
tion and fi~l, removal of obstructions, connections to existing services,
back filling, reconstruction of existing ground surface as required
to conditions existing prior to commencement of construetion, a~l
in the manner, of the matezials, and to the dimensions and to the
qrades, and in the particular locations as the same will be more
fully shown on the plans and specifications and detailed drawings
herainafter re"fezred tv;
That the structures and work and improvements herein descrihed
shall be constructied to the grades, sub-grades and elevations severally
to be shown upon the plans and profiles and detailed drawings thereof
in tha respective locations thereo.f, which said grades are hereby
adopted as the official grades therefor for all purposes in connec-
tion with the proceedings pursuan~ to this Resoiu~ion of Intention.
Notice is hereby given that said grades may be new'and di£ferent
from those heretofare established or existing, or may be different
from existing graund levels.
Ail of said work sha~l inclade, without duplica~ion, any
and ali street ~ntersections, terminations and opposite terminations
occurring within the limitations of said work.
The attention of all persons is directed to the fact that
not all of said classes of work above described may be cans~ructed
upon all ~he streets and/or public ways above descsibed in their
entirety, but only upon the.par~icular loaations as shown an the
p~ans and specifica~ions hereafter re£erred to, which said plans
and specifications sha11 govern as to ali de~ails with rela~ion to
the same.
BE IT FURTHER RESOLVED that the Board of Supervisors af
the County of Butte hereby makes the expenses and costs o£ said
improvements and acquisitions chargeable upon a district, which said
district said Board hereby declares the distzict benefited by the

improvements and acquisitions hErein described; said district shall
include tha~ territory in the County ot Butte, State of California,
which is shown on that certain map on file in the office of the
County CZerk of the County af Sutte, and which is entitled and described,
"Proposed Boundaries for Paradise Pines Country Club Estates Unit No. 4
~ Assessment District, Butte County, Cali£ornia," and which said map
indicates by a boundary line the extent of the territory included
in the proposed district and covers all details as to the extent
of the area to be assessed; said map is, by this reference, incoX-
porated herein and made a par~ hereof.
Excepting from the area shnwn and delineate~ an said mag
hereinabove referred to, the area of aIl publia streets, avenues,
lanes, roads, drives, courts, places, publzc parks, and all easements
and rights -of-way therein contained belonging to the pub~zc, and
also all property o~aned by the County of Bntte, the state of Ca~i-
fornia, or the Uni~ed States of America, cnntained therean, now in
use in.the performance of a public function.
NOTICE IS HEREBY GZVEN that serzal bpnds to represer.t unpaid
assessments, and bearing interest at the rate of seven per cent (7~)
peX annum shall be issued in the mannez and form provided in Part
5, Division 7 of the Streets and H~ghways Code o~ the State o~ Calz-
farnia (Improvement Act of 191~) to represent unpaid assessments
of Fif~y Dollars {$50.00) or over, the last installment of which
bonds shall matur~ fourteen (14) years from the 2nd day of January
next succeeding the next September lst following their datE. Sazd
bonds shall be payable to bearer, and may be redeemed as provided
in the Improvement Act of 1911, and there shall be added to the redem-
ption ciause in said bonds the following wozds:
"....togethez with a premium of five per cent {5g) of
the unmatured principal."
In case of default, there shall be added to the defaulted
amount one per cent {1~) of the amount thereof, and on the ls~ day

of each month follo~ving such defauit there shall be added a further
penalty of one per cent (I~) of such defaulted amount. The one per
cen~ (1~} penalty first imposed shall be retained by the Treasurer
as a cost of servicing the delinqnency and all subsequent penalties
shall be.paid to the holder of the bond along with and as a part
of such defaulted payment.
Proceedings for a11 wark shall be taken pursuant to the
Muniaipal Improvement Act of 19Z3, and ths bonds hereinabove described
shall be issued under the provisions of the Tmprovement Act of 191~,
~s heretafaxe described.
BE TT F~RTHER RESOLVED that in accordance wx~h the pro-
visions of Sections 10203 and 10204 of the Streets a~d Highways Code,
being a part of ~he Dianicipal Improvement Act of 1913, the matter
of the improvements and acquisitions herein referred to is hereby
referred to the Dzrector of Public Works of the County ot Butte, the
person having charge and con~roi of the improvements and acquisitians
described in this resolutzon. Said person is hereby directed ~o
make and file wi~h the CQUnty CZerk of the County of Butte, a repozt
in writing containzng the following:
a. Plans and specifications of the proposed improve-
men~ if the improvement is not already instailed;
:b. A general descrip~ion of the works or appliances
already installed and any other property necessary
or convenient for the operation of the improvemen~,
if the works, appliances or property are to be
acquired as par~ of the improvement;
c. An estimate of ~he cost of the improvement and of
the cost of lands, rights-of-way, easements and
zncidental expenses in connection with the improve-
ment. If the 2egislative boay in the resolution
of in~ention ordered tha~ private utility damages
' be included in the assessment, the report shall
contain an.estimate of privatie utility damages;
d. A diagram showzng ~he assessment district and the
' boundaries and dimenszons of the subdivisions a~
land within the d~strict as they existed at the
time of the passage of the resolution of intention.
Each subdivision, including each separete condomin-
ium interest as defined in 5ection 783 of the
Civil Code, shal~ be given a separate number upon
the diagram,

: e. A proposed assessment of the.total amount of the
cost and expenses of the proposed improvement
upon the several subdivisions of land in the
distrxct in p~oportion to tha estimated benef~ts
to be receiued by such subdivisions, respec~ively, .
f~pm the improvement. When any portion or percent-
~ age of the cost and expenses of the improvement
is ordered tio be paid out of the treasury of the
municxpalzty, pursuant to Section 10200, tihe
amount of such portion or percentage sha11 first
be deducted froM the total estimated cost and
expenses of the inprovement, and the assessment
upon property proposed in ~he repor~ shal~ include
only the remainder of tihe estima~ed cost and
expenses. The assessment shall refer ~o the sub- •
divisions by their respective numbers as assigned
pursuant to subdivision (d) of this sectian,
_ BE IT FURTHER RESOLVED that if any surplus remains in the
Improvement Fund after the completion af the zmprovements and the
payment of all ciaims from the Impravement Fund, said surplus sha~1
be distributed in accordance w~th Section 10427 of the Streets and
Highways Code.
BE IT FURTHER RESQLVEA that the Board of Supervisors hereby
finds that the public inter~st will not be served by ailawing the
property owners to take the contract ~or the work and improvements
provided for in this Resolution of zntention.
