F2ESOLUT~ON ANn ORDER APPROVING AMENDED ENGINEER'S
REPORT, ORDERING THE CONSTRUCTION OF Ih1PROVEMENTS
ANB ACQUISITIONS AND CON~iRMING ASSESSP^~NT, PARADISE
PINES COUNTRY CLUB ESTAT~S UNITS NO. 1, 2 AND 3
ASSESSMENT D~STRICT, BUTTE COUNTY, CALIFORNIA
T9HEREAS, on the 9th day of November, i971, the Board of
Supervisors of the County of Butte, State of California, adopted
its Resolution of. intention in Paradise Pines Country Club Estates
Unzts No. l, 2 and 3 nssessment Dis~rict, Butte Countiy, California,
for the constxuction of improvements and acquisitions in said assess-
ment district and referred said proposed improvements and acquisitions
to the Airector of Public 4Jorks of the County of IIutte as Engineer
of Work for saxd assessmen'~ district; and
WH~REAS, on the 9th day of November, 1971, the said
Engineer af ~~Tork filed an Engineer's Report, Assessment and Assess-
ment Diagram in accordance with sazd ]2esalution, and said Enqineer's
Repart was presented to the Board af 5upertrisors of the County of
Butte for consideration; and
[~IiER~AS, on the 9th day o£ November, 1971, the Board
of Supervisors of the County of Butte p~eliminarily adopted said
~ngzneer's Report and fixed Tuesclay, the 14th day of December, 1971,
at the hour of io:30 o'clock A.M. of. said day, at the meeting piace
of the Board of Supervisors o£ the County of Butte, located in the
Butte County Courthouse, Oroville~ Cala.fo~nia, as the time and place
for heari.ng protiES~.s with relation to said proposed improvements
and acquisitions; and
WHEREAS, pursuant to said Resolution hereinabove men~ioned
a Notice of Improvem~nt was duly pub3.ished, posted and mailed, giving
nota.ce af ~he time and place of hearing on said Repoxt; and

WHEREAS, on the 14th day of December, 1971, said hear-
ing was held and consideration of said matter was continued to the
4th day of January, 1972; and
WHER~AS, on the 4th day of ~anuary, Z972, said hearing
was held; and
WHEREAB, al1 protests having been overruled; and
WHEREAS, on the 4th day of January, 1972, the Board of
Supervisors of ttze County of Butte directed the Engineer of Work to
file an Amended Enqineer`s Repozt; an~
WH~R~AS, on the 4th day of January, 1972, the Engin~er of
Work filed ~aith the County Clerk of the County of Butte, an Amended
Engineer's Repart;
NOW~ T~IEREFORE, BE IT RESOLVED by the Board of 5upervisors
of the County of Butte, State of California, that th3.s Board does
hereby find, determine and orde~ as follows:
1. That the district henefitied by said impzovements and
acquisitions and to be assessed tio pay the costs and expenses thereof,
is more particularly described in the Resolution o~ Intention here-
inabove referred to and made a part hereof bv reference thereto.
That all ptiblic streets and highways within said assessment dis-
trict~ the same being in use in the performance of a pub].ic func-
tion as such, shal.l be omitted ~rom said district and from the levy
and colieation of the speczal assessments to be her.eafter levied
and collected to cover the costs and expenses af said improvements
and acquisitions.
2. That the p~.ans and specifica~ions for the proposed
improvements and acquisi~ions be, and they are hereby, finally adopted
and approved as the plans and speci£ications to which said work
sha11 be done as called for ~.n said Resolution of Intention.

3. That the Amended Estimate of Cast o~ the itemized
and total estimated cost and expenses of the improvements and
. acquisitions, and of the incidental expenses in connection thera-
with, which said Amended Estimate o£ Cost is on.file with the
County Clerk of the County of Butte be, and zt is hereby, finally
adopted and appzoved as the Engineer's total and detailed estimate
of the costs and expenses of said improvements and acquisitiions.
4, That the public convenience and intexest require,
and said Board hereby orders the improvemen~s and acquisitions to
be made as descxibed in, and in accordance with, said Resolution
of Intention, and the Amended Engineer's Report on file with the
County Clerk of the Coun~y of Butte, reference ta both of r~hfch
is hereby made For a more par~icular descrfption of said improvements
and acquisitions and also referenc~ is hereby made to the provi-
sions of the Municipal Improvement Act of 1913, as amended.
5. That the amount to be assessed against each of the
parcels or subdivisions of land shown on the Am~nded Engineer's
Report da~s not exceed 75ti of the market value of each of the pro-
perties assessed after the construction of improvemen~s; that the
appraisal of the mazket value of the properties ~o be assessed on
file in these proceedings is hereby adopted as the market values
of each of said parcels.
6, The BOard of Supervisors ot the County of Butte does
hereby levy and apportion upon each and every lo~, piece and parcel
of land within the houndaries of the assessment district the amount
by tahiclz each of said lots, pieaes or parcels af land is benefited
by ~he impravemen~s and acquisitions. The amount of the.assessment
which is levied and appoztioned up~n each and every 1ot, piece and
parcei nf land within the boundaries of the assessment distric~
is as shown on the assessnlen~ attached to and made a part of the

,Amended Engineer's Report adopted by this Resolution. The Board of
Supervisors of the County of Butte hereby finfls and determines that.
each of said lots, pieces or pazcels of land within the boundaries
of said district is benefited in the amount and in the proportion
of ~he total cost of. the improvements and acquisitions, plus inci-
dental expenses, which each of said 1ots, pzeces or parcels of land
has been assessed in said Amended ~ngineer's Report.
7. Collections of assessments shall be made by the County
Treasurer of the County of Butte.
~ 8. In the event any surplus remains in the Improvement
Fund aftez the comp~e~ion of the impr.ovements and the payment of
al1 a~aims from the Emprovement.Fund, said surplus shall be distri-
buted in accordance with Section 10427 of ~he Streets and Highways
Code.

I HEREBY CFR:'IFY that the foregoing resolutian was duly
and regularly adopted by the Boaxd nf Supervisors of the County of
Butte, State of California, at a rec}ular mee~ing thereof, held on
the 4th day of January, 1972, by the follocaing vote, to wit:
