~ RESOLUTION AUTHORIZING EXECUTION OF
FORB~STOWN ROAD EASEMENT AGREEMII~IT

3 BE IT RESOLVED by the Boaxd of Supervisors of the Co~nty af Butte,
~ State of California, as follows:
5 1. That said County enter into Easement Agreement with State of
6 Ca~.ifornia ~hrough its Department of General Serva.ces and as approved by i~Es
7 Department of Conserva~ion fibr rights of way needed f or road purposes on
$ Forbestown Road FAS Project 759(4), vicinity of Robinson MiIJ. F~.re Station,
9 and the Chaisman of the Board be authorized to execute an acceptance of said
10 e~sement and the terms thereof on behalf oP said County;
11 2• That G~.erk of this Board be authoriz~d to attach cert~fied cflpy
12 of this resolution to said agreement.

1. Ttiis Grant is subject to existing cont~acts, leases, licenses, easements, encumbrarcces, and tlaims

covenant against the existence of any the~eof.

taused by, arising ouc of, or in any ~+-ay connected ~+'iin the exercise of this Easement, and Grantee
agcees to save harmless, indemnify, and deiend State. its officers, ageats, and emplocees, from any

5. This Easement shall terminate in ihe e~•ent Grantee fails for a continuous period of 18 months Lo use
said Easement for the purposes herein granted. Upon such termina[ion, Grantee shall forthwith,~pon
service of ~ti3itten demand, deliver to 5tate a quitclaim deed, to its righE, title and interest hereunder,
and snali, on Sta~e request, without expense to State, and wi[hin 96 days from writ[en demand by
State, remove all ptopeity placed by or for Gcan[ee upo^ said property and restore said premises as
. neady as possible to the same condition they we[e in prior Lo the execution of this Easement. In the
event Gtantee shoutd fail to restore the premises in accordance with such request, State may do so
~ at the zisk of Grantee, and all cost and expense of such removai and restoration shall be paid 6y
Grantee upon demand.
