HomeMy WebLinkAbout72-026~soLUTiox No. ?2~26 ~ RESOLUTIOH AND ORDER APPROVING ANiENDED ENGINEER~S REPORT, ORDERII3G THE CONSTRUCT30N OF IMPROVEMENTS ANA ACQUISITIONS AiJD CONFYRM~NG ASSESSMENT, PAItAAZSE P~NES COUI`tTRY CLUB ESTATEB UNIT NO. 4 ASSESSMENT DISTRICT, BUTTE COUNTX, CALIFORNIA , WHEREAS, on the 14th day of December, I973., the Board o£ Supervisors of the County of Butte, State of California, ac3optied its 12esoiution of Intention in Faradise Pines Country Club Estates Unit No. 4 Assessment District, Butte County, California, for the cons~ruction of improvements and acquisitions in said assessment district and referred said proposed improvements and acquisitions to the Director of Public Works of the County o~ But~e.as ~ngineer of Work for said assessment district; and WHEREAS, on the 14th day of December, 7.971, the said Engineer of Work filed an Engineer's Report, Assessment and Assess- ment Diagram in accordance with said Resolution, and sai@ Engi- neer's Report was presented to the Baard of Supervisors of the County of Butt~ for consideration; and WHEREAS, on the 14th day of December, 1971, the Board of Supervisors of the Count~r of Butte preliminarily adopted said Engi- neer's Report and fixed Tuesday, the lst day of February, 1972, at the hour of 10:30 o'clock A.M. of said day, at the meeting place of the Board of Supervisors of the County of Butte, located in the Butte County Courthouse, Oroville, California, as the time and place for hearing protests with relation to said proposed improvements and acquisitions; and WHEREAS, pursuant to said Resolution hereinabove men- ti.oned a Notice of Improvement was duly published, posted and mailed, giving notice of the time and place of hearing on said Raport; an8 -1.- ~ ~ ~~ WHEREAS, on the lst day ot February, 1972, said hearing was held; and WHEREAS, on the.lst day of February, 1972, the Board of Supe~^visors of the County of Butte directed the Engineer of Woxk to tile an Amended Engiaeer's Report; and WHEREAS, on the lst day o£ February, 1972, the Engineer pf Work filed with the County Clerk of the County of Rutte an Amended Engineez's Repart; N~W- THEREFORE, BE I2' RESOLVED by the Board of SuperVisors of the Caunty af Butte, State of California, that this Board dpes heraby find, detsrmine and order as foZlows: 1. That the district benef3.ted by said improvements and acquisitions and to be assessed to pay the costs and expenses thezeo~, is more particuiarly descra.bed in the Resolution of Intention here- inab~ve referred to and made a part hereo£ by reference thereto. That a11 public streets and highways within said assessment dis- trict, the same being in use 3n the performance of a public func- tion as such, shall be omitted from said district and £zom the levy and aollection of the special assessments to be hereafter levied and collevted tio cover the costs and expenses of said improvements and acquisitions. 2. That the plans and specifications for the proposed improvements and acquisi~ions be, and they are hereby~ finaliy adopted and approved as the plans and specifications ~o which said work shall be done as called for in said Resoluti.on of intention. 3. Tha~ the Amended ~stimate of Cost of ~he itemized and total estimated cqst and expenses of the a.mprovements and acqui- sitf.ons, and o€ the inci.den~al expenses in connection therewith, which said Amended Estimate of Cost is on file with the -2- County Clerk of the County of Butte be, and it is hereby. f~nally adop~ed and approved as the Engineer's ~otal and detailed est~- mate of the costs and expenses o~ said improvements and acquisitions. 4, That the public convenience and interest require, and said Board hereby orders the improvements and acquisitions to be made as described in, and in accordance with, said Resolution of Intention, and the Amended Engineer's Report on fiie with the County Clerk of the County of Butte, reference to both of which is hereby made for a more particular description of said improvements and acquisitions and also reference is hereby made to the provi- - sions of the Municipal Improvement Act of 1913, as amended. 5. That the amount to be assessed against each of the parcels or subdivisions of land shown oa the Amended Engineer's Report does not exceed 75~ of the market vaiue o£ each of the pro~ perties assessed after the construction of imnrovements; that the appraisai of the market value of the properties to be assessed on file in these proceedings is hereby adopted as the market values of each of said parcels. 6. The Board of Supervisors of the County of Butte does hereby levy and appoxtion upon each and every lot, piece and parcel of land wi~hin the boundaries of the assessment district the amount by which each o~ said lot,s, pieees or parcels of land is benefited ' by the improvements and acquisitions. The amount of the assess- ment which is levied and apportioned upon each and every lot, piece and parce~ of land within the baundaries of the assessment dis- trict is as shown on the assessment attached to and made a part ~ of the Amended Enqineer's Report adopted by this Resolution. The Board of Supervisors af.the County of Butte hereby Einds and deter- mines that each of said lats, pieces or parcels of land within the boundaries of said dXstrict is benefited in the amount and in the proportion of the ~a~al cost of the improvements and acquisi-. ~~ons, plus inci8ental expenses, whfch each o€ said ~ots, pieces or pazcels of land has been assessed in said Amended Engineer's Report. - 3- ?. Collections of assessments shall be made by the County ~ Treasurer of the County of Butte. 8. In the event any surplus remains in the Improvement Fund after the completion of the improvements and the payment of a~l claims from the Imaravement Fund, said surpl~s shall be distri- buted in accordance with Seat~on 10427,of the Streets and High- •ways Code. * * * I HEREBY CERTIFY that thE foreqoing xesnlution was duly and regularly adopted by the Board of Supervisors of the County af Butte, State of Galifornia, at a reaular meeting thereof, held on the lst day of February, 1972, by the following vote, to wit: AYES: Supervisors Ma^ dygan, ~on, McKillop and Chairman Ga.lman ' NOES: 5upervisors None ABSENT: Supervisors Re,ynolds _ CLARIf A.
