HomeMy WebLinkAbout72-039j _. ~Z_ ~ ~ WHEREAS, there is within the boundaries of the County of Butte a cemetery known as the "Chinese Cemetery", which cemetery is described ~n Exhibit "A" and was l~istorically utilized to inter persons of Chinese ancestry who resided in various mining communi~ies ot the County; and WHEREAS, on December 21, 197I, this Board passed Resolutian.No. 71-314 expressing its intention to declare the said ~ cemetery abandoned as a place of future intermen~ and to dedicate it as a Pioneer Memorial Park aftex p~blication of the said resolution pursuant to the requirements of §882b of the Health and Sa~ety Code and the holding of a public hearing on the question; and WHEREAS, the said resolution has been pu.blished pur- suant to §8826 of the Health and Safety Code and a public hearing held on the question of abandonment of the Chinese Cemeter}r and dedication o£ it as a Pioneer Memorial Park; and WHII2EIaS, the said cemetery is not at the present time being utilized to inter human dead bodies and has not been so ~tiliz- ed in excess of five years preceding tnis date; and WHEREAS, the cemetery in its present condition en- dangers the health, safety, comfort and wel~are o~ the public in that it has been inadvertentJ.y utilized by tourists as a camping ground and the said to~rists have deposited garbage and refuse thereon; that the cemetery itself has been desecrated by unknown persons diggzng and excavating within it; that the said digging and excavating has been accomplished in such a manner that hazardous ditches, holes, excava~ tions and open graves remain; that ~rhe cemetery h.as became over-grown 7L-3~ 17ESOLUTION DECLARING ABANDONMENT OF CHINESE CEMETERY AND AEDIC,ATING IT AS A PIONEER MEA'lORIAL PARK with weeds and that persons, particularly children, could falZ intv these unmarked excavations which are concealed by weeds and could injure themselves or e.~cpose ~hemselves to disease; and that the cemetery is infested with rodents which eould harbor and spread disease; and Wt-I~REAS, the Chinese community mad.e great and signifi- cant historical contributfons to the growth snd development of Butte County. NOW, THERE~'OFtE, SE IT RESOLVED THAT the cemetery known as the Chinese Cemetery and described in Exhibit "A" shall be and is hereby declared to be abandoned as a place o~ future interment and a.s dedicated as a Pioneer Memorial. Park to be maintained by the County of Butte so that it wi11 not endanger the heal~h, safety, comfort' or weltare ot the public. BE IT FURTHER RESOLVED THAT the Butte County Historical Society shal~. be requested to inves~igate the possibility of causing a eu~.~able cen~ral memorial to be erected at the cemetery honorin.g '. those who have been interred thare. BE IT FURTHER R~SOLVED T"H,AT this resolution shall'be recorded with the County Recorder of the County of Butte.
