HomeMy WebLinkAbout72-060RESOLUTION AND ORDER OF THE BOARD OF SUPERVISORS Ok' THE CQUNTY OF BUTTE, STATE OF CALIFORNIA,CALLING AND PROVIDING E'OR A SPECIAL COUNTY BOND ELECTION FOR THE PURPOSE OF SUBMITTTNG 'TO THE QUALIFiED ELECTORS QF SAID COUNTY THE PROPOSTTTON OF WHETHER OR NOT BONDED INDEBTEDNESS OF SAID COUNTY SHOULD BE INCURRED FOR TI~E PURPQSES HEREIN SET FORTH; DECLARZNG THE ,AMOUNT OF BONDS PROPOSED TO BE ISSUED, THE MAXIMUM RATE OF INTEREST TO BE PAID THEREON AND THE MAXIMUM REDEMPTION PERIOA THII2EFORE; FIXING THE DATE OF S,.4ID ELEGITION AND THE MaSNNIl2 OF HOLDING THE SAME AN~D THE PROCEDURE FOR VOTING FOR OR AGAINST SAID PROPOSYTION; PR0~1'IDTNG FOR NOTZCE OF SAID II,ECTION AND CONSOLIDATING SAIB SPECI:9L COU~TSY BONA ELEGT30N WI~H TI~E PR~MARY ET.,ECTION TO BE HELD JUNE 6, 1972 WHEREAS, in the judgmen~. o~ the Board of Snpervisors (the "board" ) af Butte County (the '~county~~) it is necessary that the funds o~ the county shall be e~pended for the purposes herein- after set forth; and WHEREAS, there are not suffi~ient ~unds in the treasury of the county availab].e for said purposes, or any af them, or in the amount required therefor, and it is necessary that funds in addition to those on hand in the treasury of the county be raised by the issuance and sale of bonds o~ the coun~y and to that end that a special county bond election be held in accordance with law for the purpose of submitting to the crualified electors o~ the county the p~opoeition of whether or not bonds of the county shall be issued for the purposes hereinafter set frorth, so that the proposition of the issuance of said bonds may be submitted to the quaiified electors of the county at said election as herein provided, NOW, THII~EE'ORE, BE IT RESOL'V~ED ,AND ORDERED by the Board of Supervisors of Butte County, as fo~.].ows: ,, ~r Sec~ion lo A special coun~y bond election be and the same is hereby ca~~ed to be held throughout Butte County on Tuesday the 6th day o~ June, 1972, for the purpose of sabmitting to the qualified electors o~ the co~nty the proposition of incurring bonded ~ndebtedness of the county for the purposes and in the amount set ~orth in tha following measure, to wit: COUN~Y BOND MEASURES MEASURE (A): Shall the County of Butte (County Hospital incur a bonded indebted- Bonds Buildings) ness•in the principal -Yes amount of $3,OOOp00~,00 for the ob~ect and purpose of acquiring, constructing and complefiing the following county improvements, to wit: New public county buildings and improve- ments and additions to existing public county buildings necessary to carry out the work of the County Hospital, including new buildings or improvements o~ additions to existing build- ings for the hospital; lands, easements, rights- o~~way, off-street parking facilities, furniturep fixtures, equzpment, apparatus and site improve- Bonds ments tor said buildings; and other works, -No property or s~ructures necessary or convenient for said county improvemen~s; any bonds issued theretore to mature within a period not to exceed thirty years? 2a Section 2. (a) The Board does hereby submit to the qualified electors of the county at the special county bond election said county measure for the issuance of said bonds, and hereby designates and refers to said measure in the ~oxm hereinabove set forth as the measure to be set forth on the ballots hereinafter prescribed for use at the special county bond election. (b) The special county bond electzon shall be held and conducted, and the votes thereat received and canvassed, and the returns thereof made and the result thereof ascertained and determined as herein provided, and in a11 particulars not prescribed by this resolut~on and order said election shall be held as nearly as practicable in conformity with the election laws of the State of California and only qualified voters of the county may vote thereato (c) The special county bond election hereby called shall be and is hereby consolidated with the State of California ~ri~a~y E~ec~i~~ to be held throughout the county on Tuesday, j"~e-. ~~- :_ _.6, 1972, al~ as required by and pu~rsuant to law; and the election precincts, polling places and voting booths shall in eve~y case be the same and there sha11 be only one set of election officers in each o~ such precincts, The election precincts, polling places and offi.cers of election for the special county bond eJ.ection shall be the same as those designated for said General Election in the notice of po~.ling places and election officers ~or said General Eleetion to be published by the County Clerk pursuant ta law, to which notice reference is hereby specifically made for a designation ot the precinc~s, polling places and election o~ficers for the special county bond electiono The po11s for said General Election and for the special county bond election hereby consolidated therewith sha11 be opened at 7:00 AaM, on the date of said elections and shall be kep~ open until 8:00 P,M. of said day, when the polls shall be closed, except as provided in Elections Code §14436, 3. (d} Only one form of ballot sha11 be used at said General Election and the special county bond election hereby consolidated therewith, which in addition to all other matters required by law to be printed thereon, shall state the measure set forth in section 1 hereof. Votomatic ballot cards are used at said electzons except that absent voter ballots shall be paper ballots. ~ach voter to vote for ~he measure hereby submitted and for incu~ring the bonded indebtedness therein stated Sr~ ir punch the ballot card in the hoJ.e after the words T''BONDS-YES" to the right of said measure, and to vo~re against said measure and against incurring said indebtedness shall punch the ballot card in the hole after the words '~BONDS-NO'r to the rigtzt of said measure, except that to vote in favor of the measure hereby submitted and to authorize the incnrring of the indebtedness in said measure set forth, each absent voter sha11 stamp a cross (-F) in the voting square affi er the words '~BONDS-YES" an ~the ballot to the right of said measure, and to vote against the measure hereby submitted and against the incurring of the indebtedness in sai.d measure set forth, each absent ~croter shall stamp a cross (-}-) in the voting square after the words 'BONDS-NO" on the ballot to the right of said measurea (e) The County C1erk of the County shall supply ballots and stationexy and a~.l other things necessary for the conduct of said elections to the proper officers of election. (f) The returns of said elections shall be made out and signed by the election afficers and shall be by them deposited with the Coun~y Clerk, together with the ballots cast at said elections, and the said. returns shall be canvassed or caused to be canvassed by the board which shall declare the results of said election at the time and in the manner provided bq law. 4. Section 3. The amount of bonds proposed to be issued by t ne coun~y, in the event that said County Bond Measure (A} shall carry at said election is $3,000,OOOo00a Said bonds shall bear interest at a rate or rates not exceeding seven percent per annum, payable semi-annually (except that interest for the fi~st year after the date of said bonds may be made payable at the end of said year). Any bonds issued under said Measu~e (A) shall mature within a period not to exceed thirty years. Section 4. Notice of the special county bond eLection herein provided for shall be given by publication of this resoluT tion and order in the following named newspaper, to wit: Oroville Mercury (which the board hereby finds and declares to be a newspaper of general circulation printed and published in the county), once a week for at Ieast four (4) weeks prior to the holding of the speciai county bond election, and the clerk of the board zs hereby or&ered and directed to cause this resolution and order to be so published. No other notice of the election hereby called need by given. Sec~ion 5~ This resolution and order shall take effect immediately.
