g AN ORDINANCE AMENDING ORDINANCE NO. 431,
KNOWN A5 THE BUTTE COUNTY SUBDIVISION ORDINANCE
AS AMENDED BY ORDINANCE NO. 557.
4 The Board of Supervisors of the County of Butte,
State of California, do ordain as follows:
g The Butte County Subdivision Ordinance, being Ordinance
7 No. 431 of said County, as amended by Ordinance No. 5~7, is
g hereby amended in the following respects and particulars:
'. 9 1. Section 5, Part I, of said Ordinance, is amended
~~ to read as follows:
l'T SECTION 5:
12 (a} The.term "subdivivion" as used herein, shall
mean any land divided for the purpose of sale ter
13 lease, whether immediate or future, by any perso`~,
firm or corporation, into five or more parcels,
~4 excluding land dedicated for cemetery purposes, `
under the Health and Safety Code of the State of
'15 California. Provided, however, that when land
is divided far the purpose of sale or lease into
16 less than five parcels, for residential purposes,
each of such parcels shall comply with the minimum
17 lot-size requirements set foxth in Section 65,
except upon application to and approval by the
18 Planning Commission of reduced area or dimension
requirements, or both; and provided further that
19 each such parcel shall border upon an existing
public street or highway, or shall have adequate
20 access to the same by a connecting right of way
not less than sixty (60} feet in width; and provided
21 further that an exception from the provisions of
this subsection (a} of Section 5, may be granted
'22 in the event of hardship by the Board of Supervisors.
''23 (b) Other terms used herein shall have the same
meaning as prescribed in Division 4, Part 2, of
24 the Business and Professions Code of the State of
California, unless differently defined in this
!2g Ordinance.
26 This Ordinance shall take effect thirty (30) days
27 after its passage, and before the expiration of fifteen (15)
28 days after its passage, it shall be published with the names of the
29 members voting for and against it at least once in a local
30 ewspa~e~ published in the Gounty of Butte, State of California.
