A RE50LUTION FIXING BOUNDARIES AND CALLING
EI,ECTION ON FORMATZON OF TI3E
I,INIE SADDLE COMMUNITY SERVICE DISTRTC~
RESO~,VED, by ~he Board o~' Supervisors of the County of Butte,
Californ3.a, that:
WHEREAS, a pet3.tion s3.gned by at least 10~ of the regis~ered
voters within the terri~ory therein described requesting that a
district be formed under the Community Services Distric~ L,aw, stating
tne proposed name for the district, sett3.ng forth the boundaries of
the proposed distr3.ct, stating the purposes for which the district
is to be formed, and stating that tihe Board of Supervisors of the
County of'Butte shall constitute the Baard of Directoxs has been
filed with the Clerk of this Board;
WHEREAS, th~s Board, at its firs~ regular meet3.ng after the
sa3.d petition was sp filed, duly held on Tuesday, the 18th day of
April, 1g72, fixed Tuesday, the 23rd day of May , 1972, at
~he hour of 1:30 o'clock P.M. in the Chambers of said Board, Court-
house, City of' Oroville, California, as the time and place for the
hearing on the pet3.tion;
WHEREAS, notice of the said hearing, stating that a petition
for the formation of a community services distr~,ct has been filed
with the Board of Supervisors; stating the proposed name for the
di.s~r3~ct, namely, Lime Saddle Commun~.by Service Dis~rict; setting
for~h the boundaries of the distr3.ct; stating the purposes for
which the district ~.s to be formed as requested by the petition;
stating the time and place for hearing; and stiating that a~ said
hearing protests wxll be consi.dered and that requests in writing
for exclusion from or inclusion of lands in the proposed d3.stric~
will be heard and considered, was published i.n the Paradise
(California) Post, a newspaper of general circulation, circulated
within the proposed district, in the time, form and manner required
by law, as appears from ~he affidavit of publication on fi~e with
the County C1erk; and
WHEREAS, at the time stated in the notice, the Board of
Supervisors heard the petition and those appear~ng ~n favor t'hereof
and any pro~estis made orally or in ~riting against the formation
of the proposed district a~d considered any ~ritten requests fox
exclusion of land therefrom or ~nclus~pn of ~and tihere~n and
written and oxal test~.mony as to benefits, was heard and cons~dered
and evidence was tiaken on the question whether the proposed district
~s ~n ~he public interes~ and economically feasible.
NOW, THEREFORE, TT TS FOUND, -ETERMTNED and ORDERED, as
follows:
l. The petition as or3.g~.nal.l.y presented complies in every
respect with Part 2, compris3.ng Sect3.ons 61100 to 6i~.~3, inclusive,
of Division 3 of Title 6 of the Government Code, the Community
Services District Law, and sa3d petition is hereby approved,
2. The petitibn and the notice published pursuant to the
order of' the Board are genuine and sufficient in all particulars,
3. The exterior boundaries of the proposed d~.stirict are
hereby fixed and described in Exhibit "A" hereto attached and
made a part hereof by reference, and the Board hereby finds and
dec~ares that a~.~. the land included in sa3.d boundaries will be
benefiCed by inclus3on in the proposed district, that iG wlll be
~o the interest of said district to include the same, and that
no lands have been improperly omitted from or included w3.thin
s~.id d3.s tric t .
~. The proposed distric~ is in the public interest and
economically feasible.
5. The name ~of the propos~d district is hereby designated
as the L3,me Sadd~e Community Service Dis~r3.ct.

6. An election ~s hereby called and ordered ta be held
in the proposed dis~r3.ct on ~uesday, tlie 1;5t1i day of A.3~g,~~=t ~
1972, for the purposE of determ3.ning whether said district shall
be organized and formed with the boundaries as above set forth,
and subm~tted to the qualified electors of and w3thin said pxo-
posed community services district shall be the following proposi--
tion:

7. The Board of Supervisors of the County of Butte,
California, sha~1 constitute the Baard of Directors of the Lime
Saddle Community Service District.
8. Notice of the election, containing the dabe of the
e~.ection, the name of ~he proposed d~strict, the purposes for
which the district is ~o be formed, a statement that the Board
of Directioxs will be the Board of Supervisors of the Countiy of
Butte if the district 3.s formec3, and the description of' the
boundaries of ~he proposed d3.strict, shal~ be publish~d in the
Parad3.se (Californi.a) Post, a newspaper of general circulation
circula~ed w~.thin the proposed district, once a,week for two
success~.ve weeks, the ~irst of wh3ch publicat3.ons sha~l be at
least sixty-eight (68) days before the day fixed for the elec~ion,
9. The County Clerk is hereby directed to transmit, by
registered ma3.1., a written notification of the e~.ection call to
the executi.ve officer of the ~ocal Agency Formatiion Commi.ss3.on
of Butte County, withi.n five (5) days after said election call,
which notifica~3.on shall. include the name and a description of
the proposed Lime Saddle Community Service District, and which
notification may be in the form of a certified copy of tih~.s
resolution.

10. The election shall be held and conducted as p~ovided
by 1aw ~or the conduct of general district elections insofar as
app~icable, except as in said Division 3, Tit~e 6 of the Governm
ment Code otherwise provided.
11, A card stating the location of the precinct polling
p~ace af the e~ec~ox sha~1 be mai~ed to the electors residing
within the boundaries of the proposed d~s~r~ct by the County
Clerk, bu.t a failure on~~he part of any elector to receive such
notice shall not be held to inval~date the election or affect in
any manner the legality of the district if the propos~tiion carries,

13e ~or the purpose of ho~ding and conducting said elec-
tion ~ elect~on precinct is hereby establish~d, consisting
of a conso~idation of such portions of State and Coun~y precincts
as last established by the Board of Supervisors of the County of
Butte for the conduct of State and County elections as are w~th~n
the boundaries of said proposed district, The description, the
polling p~ace designated therefor and the election officers to
conduc~ said election are as shown on Exh~bit "B" hereto at~ached
and made a pa~~ hereof by reference,
14, The County C~e~k is hereby directed to procure all
supplies that may be necessary to properly'and lawfully conduc~
said election>
15, At sa~d election, the polls sha~1 be opened at seven
(7~ o°clock AoMo of the day of said election, and be kept open
until eight (8) o'clock P.M. of the same day, when the polls
shaZ~ be clos~d, except as otherwise provided ~y Sect~on 1~~36
of the Elections Codeo

When the po~ls are closed, the officers of election shal3
count tihe ballots cast tnereat, and canvass the votes cast re-
spective~y for and against the proposition for the ~ormat~on of
the proposed district, whereupon they sha~~ make re~urn thereo~
to the County Clerk in the time, form and.manner requ~red by 1aw.
16. If the majority of the vates cast at the election is
in favor of form~ng the distr3ct, the Boaxd of Supervisors shall,
by resolution entered in its m~nutes, dec~are the d~strict duly
organized under the Community Services Distr~ct Law, g~ving the
name of the d~strict a~d the purposes for whxch it is formed, and
descr~bing its boundaries. The Coun~y Clerk shall immediately
cause ~o be filed in the of~ice of the County Recorder and with
the Secretary of State a cert'ified copy of said reso~ution.
Thereupo~ the ox~anization of the district sha11 be complete.
